0014| FINANCE AUTHORITY TO ISSUE BONDS FOR COURT AUTOMATION SYSTEMS;

0015| MAKING AN APPROPRIATION; AMENDING AND ENACTING CERTAIN SECTIONS
|
0016| OF THE NMSA 1978.
|

|
0018| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0019| Section 1. Section 34-2-5 NMSA 1978 (being Laws 1933,
|
0020| Chapter 81, Section 1, as amended) is amended to read:
|
0021| "34-2-5. FEES--COLLECTION BY SUPREME COURT CLERK.--The
|
0022| clerk of the supreme court shall collect the following fees:
|
0023| A. in all cases docketed in the court, except those
|
0024| in which statutory exemption exists and those in which the court
|
0025| on showing of poverty may, by order, waive the fee, [one
|
0001| hundred dollars ($100)] one hundred twenty-five dollars
|
0002| ($125), twenty-five dollars ($25.00) of which shall be deposited
|
0003| in the court automation fund; provided that in cases in which a
|
0004| skeleton transcript may be filed for the purpose of a motion to
|
0005| docket and affirm, the fee shall be twenty dollars ($20.00),
|
0006| ten dollars ($10.00) of which shall be deposited in the court
|
0007| automation fund;
|
0008| B. for one copy of files or a record, ten cents
|
0009| ($.10) per folio and for additional copies ordered at the same
|
0010| time five cents ($.05) per folio;
|
0011| C. for comparing copies of files or records tendered
|
0012| to him, five cents ($.05) per folio; and
|
0013| D. for each certificate, one dollar ($1.00)."
|
0014| Section 2. Section 34-5-6 NMSA 1978 (being Laws 1966,
|
0015| Chapter 28, Section 6, as amended) is amended to read:
|
0016| "34-5-6. COURT OF APPEALS--FEES AND COSTS.--
|
0017| A. The clerk of the court of appeals shall collect
|
0018| the following fees:
|
0019| docket fee, twenty-five dollars ($25.00) of which shall be
|
0020| deposited in the court automation fund,
|
0021| ....................................[$100.00]

0007| B. No fees or costs shall be required in proceedings
|
0008| in forma pauperis, from state officers acting in their official
|
0009| capacity or in any other case where a statutory exemption
|
0010| exists.
|
0011| C. Except as otherwise specifically provided by
|
0012| law, the clerk of the court of appeals shall pay all fees and
|
0013| costs to the state treasurer for credit to the state general
|
0014| fund."

0015| Section 3. Section 34-6-40 NMSA 1978 (being Laws 1968,
|
0016| Chapter 69, Section 42, as amended) is amended to read:
|
0017| "34-6-40. FINANCE--FEES.--
|
0018| A. District court clerks shall collect in civil
|
0019| matters docketing any cause, whether original or reopened or by
|
0020| appeal or transfer from any inferior court, a fee of [seventy-two dollars ($72.00)] eighty-two dollars ($82.00), ten dollars
|
0021| ($10.00) of which shall be deposited in the court automation
|
0022| fund.
|
0023| B. No fees or costs shall be taxed against the
|
0024| state, its political subdivisions or the nonprofit corporations
|
0025| authorized to be formed under the Educational Assistance Act.
|
0001| C. Except as otherwise specifically provided by law,
|
0002| docket fees shall be paid into the general fund."
|
0003| Section 4. Section 34-9-10 NMSA 1978 (being Laws 1987,
|
0004| Chapter 32, Section 2, as amended) is amended to read:
|
0005| "34-9-10. COURT AUTOMATION FUND CREATED--ADMINISTRATION--
|
0006| DISTRIBUTION.--
|
0007| A. There is created in the state treasury a "court
|
0008| automation fund" to be administered by the administrative office
|
0009| of the courts.
|
0010| B. All balances in the court automation fund are
|
0011| appropriated and may be expended [only upon appropriation by
|
0012| the legislature to the administrative office of the courts] for
|
0013| service contracts related to court automation systems or for
|
0014| the purchase, lease-purchase, financing, refinancing and
|
0015| maintenance of court automation systems in the [magistrate and
|
0016| district courts] judiciary. The New Mexico finance authority
|
0017| may pledge irrevocably all distributions to the authority from
|
0018| the court automation fund for the payment of the principal,
|
0019| interest and any other expenses or obligations related to the
|
0020| bonds issued by the authority for financing court automation
|
0021| systems. Any balance remaining, after all principal, interest
|
0022| and any other expenses or obligations related to the bonds in
|
0023| each fiscal year are fully paid, may be appropriated by the
|
0024| legislature to the administrative office of the courts.
|
0025| C. Payments from the court automation fund shall be
|
0001| made upon vouchers issued and signed by the director of the
|
0002| administrative office of the courts upon warrants drawn by the
|
0003| secretary of finance and administration. Any purchase or
|
0004| lease-purchase agreement entered into pursuant to this section
|
0005| shall be entered into in accordance with the Procurement Code."
|
0006| Section 5. Section 35-6-1 NMSA 1978 (being Laws 1968,
|
0007| Chapter 62, Section 92, as amended) is amended to read:
|
0008| "35-6-1. MAGISTRATE COSTS--SCHEDULE--DEFINITION OF
|
0009| "CONVICTED".--
|
0010| A. [Each] Magistrate judges, including
|
0011| metropolitan court judges, shall collect the following costs:
|
0012| Docket fee, criminal actions under Section 29-5-1 NMSA 1978.........................................$ 1.00
|
0013| Docket fee, to be collected prior to docketing any other
|
0014| criminal action, except as provided in Subsection B of Section 35-6-3 NMSA 1978 ................. 20.00
|
0015| Docket fee, ten dollars ($10.00) of which shall be deposited in the court automation fund, to be collected prior to docketing any civil action, except
|
0016| as provided in Subsection A of Section 35-6-3 NMSA 1978 ................................ [37.00]
|
0017| 47.00
|
0018| Jury fee, to be collected from the party demanding trial by
|
0019| jury in any civil action at the time the demand is
|
0020| filed or made................................ 25.00
|
0021| Copying fee, for making and certifying copies of any records in the court, for each page copied by
|

|
0023| Copying fee, for computer-generated or electronically
|
0024| transferred copies, per page................... 1.00.
|
0025| Proceeds from this copying fee shall be transferred to the
|
0001| administrative office of the courts for deposit in the court
|
0002| automation fund. Except as otherwise specifically provided
|
0003| by law, docket fees shall be paid into the general fund.
|
0004| B. Except as otherwise provided by law, no other
|
0005| costs or fees shall be charged or collected in the magistrate
|
0006| or metropolitan court.
|
0007| C. The magistrate or metropolitan court may grant
|
0008| free process to any party in any civil proceeding or special
|
0009| statutory proceeding upon a proper showing of indigency. The
|
0010| magistrate or metropolitan court may deny free process if it
|
0011| finds that the complaint on its face does not state a cause of
|
0012| action.
|
0013| D. As used in this subsection, "convicted" means
|
0014| the defendant has been found guilty of a criminal charge by the
|
0015| magistrate or metropolitan judge, either after trial, a plea of
|
0016| guilty or a plea of nolo contendere. [Each] Magistrate
|
0017| judges, including metropolitan court judges, shall collect
|
0018| the following costs:
|
0019| (1) corrections fee, to be collected upon
|
0020| conviction from persons convicted of violating any provision of
|
0021| the Motor Vehicle Code involving the operation of a motor
|
0022| vehicle, convicted of a crime constituting a misdemeanor or a
|
0023| petty misdemeanor or convicted of violating any ordinance that
|
0024| may be enforced by the imposition of a term of
|
0025| imprisonment.......................................$10.00;
|
0001| (2) court automation fee, to be collected
|
0002| upon conviction from persons convicted of violating any
|
0003| provision of the Motor Vehicle Code involving the operation of
|
0004| a motor vehicle, convicted of a crime constituting a
|
0005| misdemeanor or a petty misdemeanor or convicted of violating
|
0006| any ordinance that may be enforced by the imposition of a term
|
0007| of imprisonment ..................................[3.00]
|
0008| 10.00;
|
0009| (3) traffic safety fee, to be collected upon
|
0010| conviction from persons convicted of violating any provision of
|
0011| the Motor Vehicle Code involving the operation of a motor
|
0012| vehicle ............................................ 3.00;
|
0013| and
|
0014| (4) judicial education fee, to be collected
|
0015| upon conviction from persons convicted of operating a motor
|
0016| vehicle in violation of the Motor Vehicle Code, convicted of a
|
0017| crime constituting a misdemeanor or a petty misdemeanor or
|
0018| convicted of violating any ordinance punishable by a term of
|
0019| imprisonment........................................ 1.00.
|
0020| E. Metropolitan court judges shall collect as costs
|
0021| a mediation fee not to exceed five dollars ($5.00) for the
|
0022| docketing of small claims and criminal actions specified by
|
0023| metropolitan court rule. Proceeds of the mediation fee shall
|
0024| be deposited into the metropolitan court mediation fund."
|
0025| Section 6. Section 35-13-2 NMSA 1978 (being Laws 1975,
|
0001| Chapter 242, Section 10, as amended) is amended to read:
|
0002| "35-13-2. APPEALS--DISTRICT COURT PROCEEDINGS--DOCKET
|
0003| FEES--JUDGMENT.--
|
0004| A. Appeals from the magistrate courts shall be
|
0005| tried de novo in the district court.
|
0006| B. The district court docket fee in any criminal
|
0007| appeal is [twenty-five dollars ($25.00)] thirty-five dollars
|
0008| ($35.00), ten dollars ($10.00) of which shall be deposited in
|
0009| the court automation fund.
|
0010| C. If the judgment of the magistrate court in a
|
0011| criminal action is affirmed or rendered against the appellant
|
0012| on appeal or if the appellant fails to appear at the time fixed
|
0013| for hearing in the district court, the district court shall
|
0014| enter judgment imposing the same, a greater or a lesser penalty
|
0015| as that imposed in the magistrate court in the action."
|
0016| Section 7. Section 35-15-7 NMSA 1978 (being Laws 1969,
|
0017| Chapter 35, Section 2) is amended to read:
|
0018| "35-15-7. APPEALS--NOTICE OF APPEALS.--
|
0019| A. An appeal from the municipal court is taken by
|
0020| filing with the clerk of the district court a notice of appeal.
|
0021| When the defendant takes an appeal, the notice of appeal shall
|
0022| be accompanied by a bond to the municipality in the sum, and
|
0023| with conditions, fixed by the municipal judge as sufficient to
|
0024| secure the appearance of the defendant, and the judgment and
|
0025| sentence of the municipal court.
|
0001| B. The clerk of the district court shall docket the
|
0002| appeal on the civil docket upon payment of a docket fee of
|
0003| twenty dollars ($20.00), ten dollars ($10.00) of which shall
|
0004| be deposited in the court automation fund, and shall transmit
|
0005| a copy of the notice of appeal to the municipal court from
|
0006| which the action is appealed and to the municipal attorney.
|
0007| C. Within ten days after receipt of the notice of
|
0008| appeal from the clerk of the district court under Subsection B
|
0009| of this section, the municipal judge shall file with the
|
0010| clerk of the district court a transcript of all municipal court
|
0011| docket entries in the action, together with all pleadings and
|
0012| other documents relating to the action. After the transcript
|
0013| has been filed, the action may be called for trial in the
|
0014| district court as in other civil actions. The appeal shall be
|
0015| governed by the Rules of Civil Procedure for the District
|
0016| Courts, except that the [municipaluty] municipality has the
|
0017| burden of proving violation of an ordinance beyond a reasonable
|
0018| doubt.
|
0019| D. The docketing of an appeal operates as a
|
0020| supersedeas and stay of execution upon the judgment of the
|
0021| municipal court in the action until final disposition of the
|
0022| appeal."
|
0023| Section 8. Section 66-8-116.3 NMSA 1978 (being Laws
|
0024| 1989, Chapter 320, Section 5, as amended) is amended to read:
|
0025| "66-8-116.3. PENALTY ASSESSMENT MISDEMEANORS--ADDITIONAL
|
0001| FEES.--In addition to the penalty assessment established for
|
0002| each penalty assessment misdemeanor, there shall be assessed:
|
0003| A. ten dollars ($10.00) to help defray the costs of
|
0004| local government corrections;
|
0005| B. a court automation fee of [three dollars
|
0006| ($3.00)] ten dollars ($10.00);
|
0007| C. a traffic safety fee of three dollars ($3.00),
|
0008| which shall be credited to the traffic safety education and
|
0009| enforcement fund; and
|
0010| D. a judicial education fee of one dollar ($1.00),
|
0011| which shall be credited to the judicial education fund."
|
0012| Section 9. [NEW MATERIAL] NEW MEXICO FINANCE
|
0013| AUTHORITY REVENUE BONDS--PURPOSE--APPROPRIATION.--
|
0014| A. The New Mexico finance authority may issue and
|
0015| sell revenue bonds in compliance with the New Mexico Finance
|
0016| Authority Act in installments or at one time in an amount not
|
0017| exceeding eight million five hundred thousand dollars
|
0018| ($8,500,000) for the purpose of financing court automation
|
0019| systems, including acquisition, development and installation of
|
0020| computer hardware and software, for the administrative office
|
0021| of the courts.
|
0022| B. The New Mexico finance authority may issue and
|
0023| sell revenue bonds authorized by this section when the director
|
0024| of the administrative office of the courts certifies the need
|
0025| for issuance of the bonds. The net proceeds from the sale of
|
0001| the bonds are appropriated to the administrative office of the
|
0002| courts for the purposes described in Subsection A of this
|
0003| section.
|
0004| C. Except for money appropriated by the legislature
|
0005| from the court automation fund to the administrative office of
|
0006| the courts in fiscal year 1997, the money in the court
|
0007| automation fund shall be distributed to the New Mexico finance
|
0008| authority to be pledged irrevocably for the payment of the
|
0009| principal, interest and other expenses or obligations related
|
0010| to the bonds.
|
0011| D. The money in the court automation fund shall be
|
0012| distributed monthly to the New Mexico finance authority and
|
0013| deposited in a special bond fund or account of the authority.
|
0014| At the end of each fiscal year, any money remaining in the
|
0015| special bond fund or account from distributions made to the
|
0016| authority during that fiscal year, after all principal,
|
0017| interest and any other expenses or obligations related to the
|
0018| bonds in that fiscal year are fully paid, may be appropriated
|
0019| by the legislature to the administrative office of the courts
|
0020| for service contracts related to court automation systems or
|
0021| for the purchase, lease-purchase, financing, refinancing and
|
0022| maintenance of court automation systems in the judiciary. Upon
|
0023| payment of all principal, interest and any other expenses or
|
0024| obligations related to the bonds, the authority shall certify
|
0025| to the administrative office of the courts that all obligations
|
0001| for the bonds issued pursuant to this section have been fully
|
0002| discharged and direct the administrative office of the courts
|
0003| to cease distributing money from the court automation fund to
|
0004| the authority.
|
0005| E. Any law authorizing the collection of fees for
|
0006| the court automation fund or distribution of the money in the
|
0007| court automation fund to the New Mexico finance authority shall
|
0008| not be amended, repealed or otherwise directly or indirectly
|
0009| modified so as to impair any outstanding revenue bonds that may
|
0010| be secured by a pledge of the distributions of the court
|
0011| automation fund, unless the revenue bonds have been discharged
|
0012| in full or provisions have been made for a full discharge.
