0012| RELATING TO CAPITAL EXPENDITURES; AUTHORIZING THE ISSUANCE OF
|
0013| SEVERANCE TAX BONDS FOR CERTAIN CAPITAL PROJECTS IN HOUSE
|
0014| DISTRICT 42 LOCATED IN TAOS COUNTY; MAKING APPROPRIATIONS;
|
0015| DECLARING AN EMERGENCY.
|

0017| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0018| Section 1. SEVERANCE TAX BONDS--AUTHORIZATIONS--
|
0019| APPROPRIATION OF PROCEEDS.--
|
0020| A. The state board of finance may issue and sell
|
0021| severance tax bonds in compliance with the Severance Tax Bonding
|
0022| Act in an amount not to exceed the total of the amounts
|
0023| authorized for purposes specified in Sections 2 through 10 of
|
0024| this act. The state board of finance shall schedule the
|
0025| issuance and sale of the bonds in the most expeditious and
|
0001| economical manner possible upon a finding by the board that the
|
0002| project has been developed sufficiently to justify the issuance
|
0003| and that the project can proceed to contract within a reasonable
|
0004| time. The state board of finance shall further take the
|
0005| appropriate steps necessary to comply with the Internal Revenue
|
0006| Code of 1986, as amended. Proceeds from the sale of the bonds
|
0007| are appropriated for the purposes specified in Sections 2
|
0008| through 10 of this act.
|
0009| B. The agencies named in Sections 2 through 10 of
|
0010| this act shall certify to the state board of finance when the
|
0011| money from the proceeds of the severance tax bonds authorized in
|
0012| this section is needed for the purposes specified in the
|
0013| applicable section of this act.
|
0014| C. If the specified agency has not certified the
|
0015| need for the issuance of the bonds by the end of fiscal year
|
0016| 1998, the authorization provided in this act shall be void.
|
0017| D. Unless otherwise specified in this act, any
|
0018| unexpended or unencumbered balance remaining from the proceeds
|
0019| of severance tax bonds issued pursuant to Sections 2 through 10
|
0020| of this act at the end of fiscal year 1999 shall revert to the
|
0021| severance tax bonding fund.
|
0022| Section 2. SEVERANCE TAX BONDS--DEPARTMENT OF
|
0023| ENVIRONMENT--PURPOSES.--Pursuant to the provisions of Section 1
|
0024| of this act, upon certification by the department of environment
|
0025| that the need exists for the issuance of the bonds, the
|
0001| following amounts are appropriated to the department of
|
0002| environment for the following purposes:
|
0003| A. one hundred thousand dollars ($100,000) to plan,
|
0004| design and make improvements to the water and sewer lines in the
|
0005| village of Questa located in Taos county;
|
0006| B. one hundred twenty-five thousand dollars
|
0007| ($125,000) to make improvements to the community well in Cerro
|
0008| located in Taos county;
|
0009| C. one hundred fifty thousand dollars ($150,000) to
|
0010| make improvements to the water system in Arroyo Seco located in
|
0011| Taos county;
|
0012| D. fifty thousand dollars ($50,000) to conduct a
|
0013| water and sewer feasibility study for the Penasco valley located
|
0014| in Taos county;
|
0015| E. one hundred thousand dollars ($100,000) to make
|
0016| improvements to the water system in upper Arroyo Hondo located
|
0017| in Taos county;
|
0018| F. one hundred thousand dollars ($100,000) to
|
0019| continue the improvements to the water line and water system
|
0020| project in Vadito located in Taos county;
|
0021| G. two hundred eighteen thousand dollars ($218,000)
|
0022| to purchase and install a water storage tank and make
|
0023| improvements to the Penasco water system in Taos county; and
|
0024| H. two hundred four thousand dollars ($204,000) to
|
0025| purchase and install a water storage tank and make improvements
|
0001| to the El Prado water system in Taos county.
|
0002| Section 3. SEVERANCE TAX BONDS--DEPARTMENT OF FINANCE AND
|
0003| ADMINISTRATION--PURPOSES.--Pursuant to the provisions of Section
|
0004| 1 of this act, upon certification by the local government
|
0005| division of the department of finance and administration that
|
0006| the need exists for the issuance of the bonds, the following
|
0007| amounts are appropriated to the local government division of the
|
0008| department of finance and administration for the following
|
0009| purposes:
|
0010| A. one hundred thousand dollars ($100,000) to plan,
|
0011| design, construct and equip a public works facility in Questa
|
0012| located in Taos county;
|
0013| B. one hundred twenty-five thousand dollars
|
0014| ($125,000) to plan, design and make improvements to the
|
0015| municipal parking lot in Red River located in Taos county;
|
0016| C. one hundred twenty-five thousand dollars
|
0017| ($125,000) to purchase a public school building for the town of
|
0018| Red River located in Taos county;
|
0019| D. fifty thousand dollars ($50,000) to plan, design,
|
0020| renovate and make improvements to the municipal facility in Red
|
0021| River located in Taos county;
|
0022| E. twenty-five thousand dollars ($25,000) to
|
0023| purchase equipment for the little league baseball program in the
|
0024| town of Taos located in Taos county;
|
0025| F. twenty-five thousand dollars ($25,000) to
|
0001| purchase equipment for the Taos little league basketball program
|
0002| in Taos county;
|
0003| G. two hundred thousand dollars ($200,000) to extend
|
0004| electric transmission lines to the Ski Rio resort located in
|
0005| Taos county;
|
0006| H. one hundred fifty thousand dollars ($150,000) to
|
0007| purchase vehicles for the Taos county sheriff's office;
|
0008| I. four hundred thousand dollars ($400,000) to
|
0009| complete various capital projects in Taos county in order to
|
0010| comply with the federal Americans with Disabilities Act of 1990;
|
0011| J. seventy-five thousand dollars ($75,000) to
|
0012| renovate the youth center in Penasco located in Taos county;
|
0013| K. three hundred thousand dollars ($300,000) to
|
0014| plan, design and construct a youth and family center in the town
|
0015| of Taos located in Taos county;
|
0016| L. two hundred fifty-eight thousand dollars
|
0017| ($258,000) to complete phase two of the construction of the
|
0018| indoor arena at the agricultural center located in Taos county;
|
0019| M. three hundred thousand dollars ($300,000) to
|
0020| complete the outpatient and conference rooms in the
|
0021| detoxification project in Taos located in Taos county; and
|
0022| N. two hundred thousand dollars ($200,000) to
|
0023| purchase or construct a community center in the Costilla-Amalia
|
0024| area of Taos county.
|
0025| Section 4. SEVERANCE TAX BONDS--STATE AGENCY ON AGING--PURPOSES.--Pursuant to the provisions of Section 1 of this act,
|
0001| upon certification by the state agency on aging that the need
|
0002| exists for the issuance of the bonds, the following amounts are
|
0003| appropriated to the state agency on aging for the following
|
0004| purposes:
|
0005| A. one hundred fifty thousand dollars ($150,000) to
|
0006| plan, design, renovate and make improvements to the senior
|
0007| center in Questa located in Taos county; and
|
0008| B. one hundred ninety thousand dollars ($190,000) to
|
0009| plan, design, construct or renovate a senior center and purchase
|
0010| vehicles for Taos pueblo located in Taos county.
|
0011| Section 5. SEVERANCE TAX BONDS--UNIVERSITY OF NEW MEXICO--PURPOSES.--Pursuant to the provisions of Section 1 of this act,
|
0012| upon certification by the board of regents of the university of
|
0013| New Mexico that the need exists for the issuance of the bonds,
|
0014| the following amounts are appropriated to the board of regents
|
0015| of the university of New Mexico for the following purposes:
|
0016| A. one million twenty-five thousand dollars
|
0017| ($1,025,000) to plan, design and construct phase two of the
|
0018| off-campus instructional site located in Taos county; and
|
0019| B. fifty thousand dollars ($50,000) to purchase and
|
0020| install computers for the classroom facility computer laboratory
|
0021| at the off-campus instructional site located in Taos county.
|
0022| Section 6. SEVERANCE TAX BONDS--STATE HIGHWAY AND
|
0023| TRANSPORTATION DEPARTMENT--PURPOSES.--Pursuant to the provisions
|
0024| of Section 1 of this act, upon certification by the state
|
0025| highway and transportation department that the need exists for
|
0001| the issuance of the bonds, the following amounts are
|
0002| appropriated to the state highway and transportation department
|
0003| for the following purposes:
|
0004| A. five hundred thousand dollars ($500,000) to
|
0005| repave and make improvements to county road C-21 in Rodarte
|
0006| located in Taos county;
|
0007| B. six hundred thousand dollars ($600,000) to plan,
|
0008| design and construct the western extension to state road 585 in
|
0009| Taos located in Taos county; and
|
0010| C. two hundred fifty thousand dollars ($250,000) to
|
0011| pave, make improvements to and purchase equipment for the roads
|
0012| within Taos pueblo located in Taos county.
|
0013| Section 7. SEVERANCE TAX BONDS--OFFICE OF THE STATE
|
0014| ENGINEER--PURPOSES.--Pursuant to the provisions of Section 1 of
|
0015| this act, upon certification by the office of the state engineer
|
0016| that the need exists for the issuance of the bonds, the
|
0017| following amounts are appropriated to the office of the state
|
0018| engineer for the following purposes:
|
0019| A. forty thousand dollars ($40,000) to purchase
|
0020| equipment for the ditch association in Questa located in Taos
|
0021| county; and
|
0022| B. twenty thousand dollars ($20,000) to reconstruct
|
0023| and make improvements to a head gate for the Acequia de Arriba
|
0024| in El Valle located in Taos county.
|
0025| Section 8. SEVERANCE TAX BONDS--STATE DEPARTMENT OF PUBLIC
|
0001| EDUCATION--PURPOSES.--Pursuant to the provisions of Section 1 of
|
0002| this act, upon certification by the state department of public
|
0003| education that the need exists for the issuance of the bonds,
|
0004| the following amounts are appropriated to the state department
|
0005| of public education for the following purposes:
|
0006| A. seven hundred fifty-nine thousand dollars
|
0007| ($759,000) to renovate and construct additions to Ranchos
|
0008| elementary, Taos junior high and Taos high schools located in
|
0009| Taos county;
|
0010| B. two hundred twenty-five thousand dollars
|
0011| ($225,000) to complete a waste treatment plant for the Penasco
|
0012| school district located in Taos county; and
|
0013| C. seven hundred fifty thousand dollars ($750,000)
|
0014| to complete the construction of classrooms and a multipurpose
|
0015| room at the elementary school in Penasco located in Taos county.
|
0016| Section 9. SEVERANCE TAX BONDS--NEW MEXICO OFFICE OF
|
0017| INDIAN AFFAIRS--PURPOSES.--Pursuant to the provisions of Section
|
0018| 1 of this act, upon certification by the New Mexico office of
|
0019| Indian affairs that the need exists for the issuance of the
|
0020| bonds, the following amounts are appropriated to the New Mexico
|
0021| office of Indian affairs for the following purposes:
|
0022| A. three hundred twelve thousand dollars ($312,000)
|
0023| to complete the headstart construction project at Taos pueblo
|
0024| located in Taos county;
|
0025| B. one million five hundred thousand dollars
|
0001| ($1,500,000) to construct a water quality standard office in
|
0002| Taos pueblo located in Taos county;
|
0003| C. one million five hundred thousand dollars
|
0004| ($1,500,000) to plan, design, construct and equip a tribal
|
0005| archive and storage facility for Taos pueblo located in Taos
|
0006| county;
|
0007| D. thirty thousand dollars ($30,000) to plan, design
|
0008| and construct or acquire a warchief office and bison storage
|
0009| facility in Taos pueblo located in Taos county;
|
0010| E. twenty-five thousand dollars ($25,000) to
|
0011| complete the warchief's agriculture building in Taos pueblo
|
0012| located in Taos county;
|
0013| F. sixty thousand dollars ($60,000) to complete
|
0014| range, corral and water resource development for the bison
|
0015| relocation project in Taos pueblo located in Taos county;
|
0016| G. seventy-five thousand dollars ($75,000) to
|
0017| improve the collection site or develop a permanent transfer
|
0018| station for solid waste in Taos pueblo located in Taos county;
|
0019| H. thirty thousand dollars ($30,000) to maintain the
|
0020| wilderness programs in Taos pueblo located in Taos county; and
|
0021| I. two hundred fifty thousand dollars ($250,000) to
|
0022| complete the second phase of the construction of the community
|
0023| center in Picuris pueblo located in Taos county.
|
0024| Section 10. SEVERANCE TAX BONDS--STATE ARMORY BOARD--PURPOSE.--Pursuant to the provisions of Section 1 of this act,
|
0025| upon certification by the state armory board that the need
|
0001| exists for the issuance of the bonds, five hundred twenty-two
|
0002| thousand dollars ($522,000) is appropriated to the state armory
|
0003| board for the purpose of designing, constructing, equipping and
|
0004| making other improvements for a national guard armory in Taos
|
0005| county.
|
0006| Section 11. EMERGENCY.--It is necessary for the public
|
0007| peace, health and safety that this act take effect immediately.
