0012| RELATING TO MOTOR VEHICLES; CREATING SENIOR CITIZEN PARKING

0013| SPACES AND SPECIAL PLACARDS; ENACTING CERTAIN SECTIONS OF THE
|
0014| MOTOR VEHICLE CODE; MAKING AN APPROPRIATION.
|

0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. A new section of the Motor Vehicle Code is
|
0018| enacted to read:
|
0019| "[NEW MATERIAL] DESIGNATED PARKING SPACES FOR SENIOR
|
0020| CITIZENS--STANDARDS.--
|
0021| A. Every parking lot under the provisions of the
|
0022| Disabled Parking Standards and Enforcement Act may have
|
0023| designated senior citizen parking spaces as provided in
|
0024| Subsection B of this section; provided that designated senior
|
0025| citizen parking spaces shall not be required for parking lots
|
0001| with less than twenty-five spaces.
|
0002| B. The minimum numbers of designated senior citizen
|
0003| parking spaces are as follows:
|
0004| TOTAL SPACES IN PARKING LOT MINIMUM DESIGNATED SENIOR
|
0005| CITIZEN PARKING SPACES
|
0006| 0 to 25 0
|
0007| 26 to 35 1
|
0008| 36 to 50 2
|
0009| 51 to 100 3
|
0010| 101 to 300 4
|
0011| 301 to 500 5
|
0012| 501 to 800 6
|
0013| 801 to 1,000 7
|
0014| more than 1,000 8, plus 3 for
|
0015| each additional 1,000.
|
0016| The designated senior citizen parking spaces shall be located
|
0017| to provide convenient access to entranceways or to the nearest
|
0018| curb cut, subject to provisions for disabled parking spaces in
|
0019| the Disabled Parking Standards and Enforcement Act.
|
0020| The senior citizen parking spaces shall not take precedence over
|
0021| the disabled parking spaces, nor shall they be located closer to
|
0022| the entranceways than the disabled parking spaces.
|
0023| C. Each designated senior citizen parking space
|
0024| shall be identified by a grey and white diagonal stripe design.
|
0025| D. For purposes of this section, "senior citizen"
|
0001| means a person who is seventy-five years of age or older."
|
0002| Section 2. A new section of the Motor Vehicle Code is
|
0003| enacted to read:
|
0004| "[NEW MATERIAL] UNAUTHORIZED USE--PENALTY.--
|
0005| A. In accordance with Section 3 of this act, it is
|
0006| unlawful to park a motor vehicle not displaying a senior citizen
|
0007| sticker or placard in a designated senior citizen parking space
|
0008| or blocking a curb cut. Any person who violates this subsection
|
0009| is subject to a fine of fifty dollars ($50.00).
|
0010| B. A person charged with a violation of Subsection A
|
0011| of this section shall be determined not to have committed an
|
0012| infraction if he produces in court a senior citizen sticker or
|
0013| placard, in accordance with Section 3 of this act, or if he
|
0014| demonstrates that he was entitled to a sticker or placard at the
|
0015| time of the violation."
|
0016| Section 3. A new section of the Motor Vehicle Code is
|
0017| enacted to read:
|
0018| "[NEW MATERIAL] SENIOR CITIZEN DISPLAY DEVICES.--
|
0019| A. Upon written application to the department, a
|
0020| senior citizen may be granted the issuance of a sticker or
|
0021| placard for display upon a motor vehicle that is owned by the
|
0022| applicant, or by the employer of the senior citizen when the
|
0023| vehicle is assigned to and used by the senior citizen, or owned
|
0024| by another person who is transporting the senior citizen. The
|
0025| department shall charge a fee of five dollars ($5.00) to cover
|
0001| the cost of the display device and of its issuance. The fee
|
0002| shall be retained by the department and is appropriated to the
|
0003| department for expenditure incurred in carrying out the
|
0004| provisions of this section.
|
0005| B. Each senior citizen sticker or placard issued by
|
0006| the secretary shall be identified by a grey and white diagonal
|
0007| stripe design.
|
0008| C. Stickers or placards issued to a senior citizen
|
0009| by another state or foreign jurisdiction shall be granted
|
0010| reciprocity while the vehicle and senior citizen operator are in
|
0011| this state for a period not to exceed thirty days.
|
0012| D. For purposes of this section, "senior citizen"
|
0013| means a person who is seventy-five years of age or older."
|
0014| Section 4. EFFECTIVE DATE.--The effective date of the
|
0015| provisions of this act is September 1, 1996.
