0012| RELATING TO WAGE CLAIMS; AUTHORIZING THE DIRECTOR OF THE LABOR
|
0013| AND INDUSTRIAL DIVISION OF THE LABOR DEPARTMENT TO APPEAR
|
0014| WITHOUT COUNSEL IN MAGISTRATE AND METROPOLITAN COURTS.
|

0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. Section 50-4-12 NMSA 1978 (being Laws 1937,
|
0018| Chapter 109, Section 13, as amended) is amended to read:
|
0019| "50-4-12. WAGE CLAIM ACTIONS--COSTS--JURISDICTION--REPRESENTATION BY DISTRICT ATTORNEY--APPEALS.--
|
0020| [(a)] A. In all actions brought by the [labor
|
0021| commissioner] director of the labor and industrial division of
|
0022| the labor department as assignee under the provisions of [the
|
0023| preceding section] Section 50-4-11 NMSA 1978, the [labor
|
0024| commissioner] director shall be entitled to free process and
|
0025| shall not be obligated or required to give any bond or other
|
0001| security for costs.
|
0002| [(b)] B. Any sheriff, constable or other officer
|
0003| requested by the [labor commissioner] director to serve any
|
0004| summons, writ, complaint or order shall do so without requiring
|
0005| the [labor commissioner] director to [advance the] pay
|
0006| any fees or furnish any security or bond [therefor].
|
0007| [(c)] C. Where [the claim or] all claims
|
0008| [are less or when] joined together [are less] do not
|
0009| exceed in the aggregate [than] the [sum of two hundred
|
0010| dollars ($200)] jurisdictional limit of the magistrate or
|
0011| metropolitan court, the [labor commissioner] director may
|
0012| institute an action [therefor] against the employer in any
|
0013| [justice of the peace] magistrate or metropolitan court
|
0014| having jurisdiction without referring the [same] claim to
|
0015| the district attorney. In the event that during the course of
|
0016| the proceedings representation by an attorney at law [to
|
0017| represent the labor commissioner] becomes necessary or, in his
|
0018| judgment, advisable, [it shall be his duty to] the director
|
0019| shall so notify the district attorney [of the pendency of said
|
0020| cause and the date of the hearing thereof], and it shall then
|
0021| be the duty of [said] the district attorney [to appear by
|
0022| himself] or his assistant to appear for [in said justice of
|
0023| the peace court and represent said labor commissioner in such]
|
0024| the director in the cause.
|
0025| D. In the event [such] the cause is appealed
|
0001| by the [state labor commissioner or docketed in the district
|
0002| court for judgment] director, no bond or other security
|
0003| [for costs] shall be required or fees charged [to the
|
0004| commissioner] the director for court costs or sheriff's fees
|
0005| in serving process."
