0013| MATERIALS TRANSPORTATION ACT TO ESTABLISH A HAZARDOUS MATERIALS

0014| TRANSPORTATION PERMIT PROGRAM; AMENDING THE EMERGENCY MANAGEMENT
|
0015| ACT; PROVIDING A PENALTY; AMENDING, REPEALING AND ENACTING
|
0016| SECTIONS OF THE NMSA 1978.
|

|
0018| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0019| Section 1. [NEW MATERIAL] SHORT TITLE.--Sections 1
|
0020| through 8 of this act may be cited as the "Hazardous Materials
|
0021| Transportation Act".
|
0022| Section 2. [NEW MATERIAL] DEFINITIONS.--As used in the
|
0023| Hazardous Materials Transportation Act:
|
0024| A. "department" means the taxation and revenue
|
0025| department;
|
0001| B. "hazardous material" means:
|
0002| (1) a material of a type or in a quantity that
|
0003| requires the transport vehicle to be placarded as a carrier of
|
0004| hazardous material in accordance with the Code of Federal
|
0005| Regulations, Title 49, Part 171.8 or Part 172; or
|
0006| (2) a hazardous substance or marine pollutant as
|
0007| defined in the Code of Federal Regulations, Title 49, Section
|
0008| 171.8 when transported in bulk packaging;
|
0009| C. "person" means an individual or any other legal
|
0010| entity; and
|
0011| D. "public entity" means an agency, instrumentality
|
0012| or political subdivision of a federal, state or Indian
|
0013| government.
|
0014| Section 3. [NEW MATERIAL] HAZARDOUS MATERIALS
|
0015| TRANSPORTATION PERMIT--DEPARTMENT DUTIES--FEES.--
|
0016| A. Except as provided in Section 4 of the Hazardous
|
0017| Materials Transportation Act, a person may not transport a
|
0018| hazardous material on a state or federal highway without a
|
0019| permit from the department.
|
0020| B. The department shall establish regulations for
|
0021| the issuance of hazardous materials transportation permits and
|
0022| shall issue permits to applicants who meet the requirements of
|
0023| the regulations.
|
0024| C. Hazardous materials transportation permits shall
|
0025| be issued for a period not to exceed twelve months for a fee of
|
0001| two hundred fifty dollars ($250), regardless of the number of
|
0002| vehicles or combination of vehicles operated by the permit
|
0003| applicant, or the department may issue a permit for a single
|
0004| shipment of hazardous materials for a fee of seventy-five
|
0005| dollars ($75.00).
|
0006| D. Public entities may acquire a hazardous materials
|
0007| transportation permit exempt from the fee in Subsection C of
|
0008| this section.
|
0009| E. A copy of any hazardous materials transportation
|
0010| permit issued pursuant to this section shall be carried in each
|
0011| vehicle included under conditions of the permit. Hazardous
|
0012| materials transportation permits shall be open for inspection by
|
0013| any peace officer.
|
0014| F. Fees collected pursuant to this section shall be
|
0015| deposited in the general fund.
|
0016| Section 4. [NEW MATERIAL] EXEMPTIONS.--The following
|
0017| activities are exempt from the Hazardous Materials
|
0018| Transportation Act:
|
0019| A. the transportation of pesticides as defined in
|
0020| Subsection N of Section 76-4-3 NMSA 1978 in quantities not
|
0021| required to be placarded under the Code of Federal Regulations,
|
0022| Title 49, Part 172 when transported by a commercial applicator
|
0023| as defined in Subsection W of Section 76-4-3 NMSA 1978;
|
0024| B. the transportation by a farmer or a rancher of a
|
0025| hazardous material for use on a farm or a ranch;
|
0001| C. the transportation of a hazardous waste
|
0002| designated as "special waste" by the department and the
|
0003| secretary of environment;
|
0004| D. the transportation of a fertilizer or
|
0005| agricultural chemical by the retailer of the product to a farm
|
0006| or a ranch within a seventy-five mile radius of the retailer for
|
0007| use only on the farm or the ranch to which the material is
|
0008| transported; and
|
0009| E. the transportation of drilling fluids, produced
|
0010| waters and other wastes associated with the exploration,
|
0011| development or production of crude oil, natural gas or
|
0012| geothermal energy.
|
0013| Section 5. [NEW MATERIAL] PERMIT SUSPENSION, REVOCATION
|
0014| OR DENIAL.--The department may suspend or revoke a hazardous
|
0015| materials transportation permit or order the suspension of the
|
0016| transportation of hazardous material under a permit if a
|
0017| permittee violates conditions of a hazardous materials
|
0018| transportation permit. The department shall not issue a permit
|
0019| to an applicant who has violated the conditions of a hazardous
|
0020| materials transportation permit issued by this state, another
|
0021| state or the federal government or to any applicant who has
|
0022| violated Section 3 of the Hazardous Materials Transportation
|
0023| Act. A person is entitled to a hearing if the person's
|
0024| application for a permit has been denied or if the person's
|
0025| permit has been suspended or revoked.
|
0001| Section 6. [NEW MATERIAL] BASE STATE AGREEMENTS.--The
|
0002| department may enter into agreements with other states, the
|
0003| federal government, Canada, Mexico or other participating
|
0004| organizations to provide for reciprocal permitting of persons
|
0005| transporting hazardous materials and for the efficient
|
0006| administration of the Hazardous Materials Transportation Act.
|
0007| Section 7. [NEW MATERIAL] PREEMPTION.--All existing
|
0008| hazardous materials transportation registration or permitting
|
0009| programs administered by political subdivisions of the state are
|
0010| void and preempted by the Hazardous Materials Transportation
|
0011| Act.
|
0012| Section 8. [NEW MATERIAL] CIVIL PENALTY.--Any person
|
0013| who violates Section 3 of the Hazardous Materials Transportation
|
0014| Act shall be subject to a civil penalty not to exceed two
|
0015| thousand dollars ($2,000) for each offense. All actions to
|
0016| recover the penalties provided for in this section may be
|
0017| brought by the department before a district court. The
|
0018| department may bring an action in the district court seeking
|
0019| injunctive relief to enforce provisions of the Hazardous
|
0020| Materials Transportation Act. All penalties recovered in any
|
0021| such action shall be paid into the general fund.
|
0022| Section 9. Section 74-4B-4 NMSA 1978 (being Laws 1983,
|
0023| Chapter 80, Section 4, as amended) is amended to read:
|
0024| "74-4B-4. STATE RESPONSIBILITY FOR MANAGEMENT OF
|
0025| ACCIDENTS--IMMUNITY FROM LIABILITY--COOPERATIVE AGREEMENTS--PRIVATE PROPERTY.--
|
0001| A. The secretary shall have final authority to
|
0002| administer the provisions of the Emergency Management Act.
|
0003| B. As between state and local governments, the state
|
0004| government has the primary responsibility for the management of
|
0005| an accident, and the local government in whose jurisdiction the
|
0006| accident occurs shall assist the state in its management of the
|
0007| accident.
|
0008| C. Nothing in the Emergency Management Act shall be
|
0009| construed as a waiver or alteration of the immunity from
|
0010| liability granted under the Tort Claims Act or as a waiver of
|
0011| any other immunity or privilege under law.
|
0012| D. The state, through the secretary or his designee,
|
0013| may enter into cooperative agreements with county and municipal
|
0014| governments for the management of accidents based on the
|
0015| severity of the accident and the resources of the local
|
0016| government. The plan shall set forth the criteria for
|
0017| determining when an accident may be managed by the local
|
0018| government in whose jurisdiction the accident occurred.
|
0019| E. The secretary shall support emergency response
|
0020| capabilities by assisting local and state responders in the
|
0021| acquisition of equipment, training and hazardous materials
|
0022| information.
|
0023| [E.] F. The state, through the secretary or his
|
0024| designee, may enter into cooperative agreements with the federal
|
0025| government, Indian tribes and pueblos and bordering states for
|
0001| assistance in the management of accidents.
|
0002| [F.] G. Whenever an accident appears imminent or
|
0003| has occurred employees or authorized persons of responsible
|
0004| state agencies as defined in Section 74-4B-5 NMSA 1978 are
|
0005| authorized to enter upon any [buildings or] premises for the
|
0006| purpose of determining whether it is necessary for emergency
|
0007| management procedures to be implemented. The state on-scene
|
0008| coordinator or a responsible state agency may take full control
|
0009| and custody of [such buildings and] the premises for the
|
0010| purpose of managing the accident."
|
0011| Section 10. REPEAL.--Section 7-15A-11 NMSA 1978 (being
|
0012| Laws 1988, Chapter 14, Section 2, as amended) is repealed.
|
0013| Section 11. EFFECTIVE DATE.--The effective date of the
|
0014| provisions of this act is July 1, 1996.
