0012| RELATING TO ENVIRONMENTAL PROTECTION; PROVIDING FOR THE USE OF

0013| RECYCLED TIRE RUBBER IN TRANSPORTATION-RELATED APPLICATIONS;

0014| MAKING AN APPROPRIATION.
|

0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. Section 74-11-14 NMSA 1978 (being Laws 1994,
|
0018| Chapter 117, Section 14 and also Laws 1994, Chapter 126, Section
|
0019| 14) is amended to read:
|
0020| "74-11-14. [RUBBERIZED ASPHALT] RECYCLED TIRE RUBBER
|
0021| PROGRAM.--The state highway and transportation department shall
|
0022| establish a program for and is authorized to use recycled tire
|
0023| rubber in rubberized asphalt [in] paving mixtures and other
|
0024| transportation-related applications for state and local highway
|
0025| or transportation projects and to pay any added expenses that
|
0001| may result from [using rubberized asphalt] those uses. The
|
0002| [state highway and transportation] department shall adopt
|
0003| [rules] regulations for the administration of the
|
0004| [rubberized asphalt] recycled tire rubber program, including
|
0005| the development of procedures for disbursement of money to
|
0006| municipalities and counties for the use of recycled tire rubber
|
0007| in rubberized asphalt [in] paving mixtures and other
|
0008| transportation-related applications and shall develop
|
0009| [paving] or approve specifications for [the use of
|
0010| rubberized asphalt] those uses."
|
0011| Section 2. Section 74-11-16 NMSA 1978 (being Laws 1994,
|
0012| Chapter 117, Section 16 and also Laws 1994, Chapter 126, Section
|
0013| 16) is amended to read:
|
0014| "74-11-16. RUBBERIZED ASPHALT FUND CREATED.--The
|
0015| "rubberized asphalt fund" is created in the state treasury.
|
0016| Money in the fund is appropriated to the state highway and
|
0017| transportation department to pay additional expenses that
|
0018| [might] result from [using] the recycled tire rubber
|
0019| program established pursuant to Section 74-11-14 NMSA 1978,
|
0020| including use of recycled tire rubber in rubberized asphalt
|
0021| paving mixes [to allocate at least fifty percent of the fund to
|
0022| local governments for that purpose and for carrying] and other
|
0023| transportation-related applications and to carry out the
|
0024| [provisions of the rubberized asphalt] recycled tire rubber
|
0025| program, including hiring a term employee to administer the
|
0001| program. The department may allocate up to fifty percent of
|
0002| money in the fund to local governments pursuant to the
|
0003| department's recycled tire rubber program regulations. Any
|
0004| unexpended or unencumbered balance remaining in the rubberized
|
0005| asphalt fund at the end of a fiscal year shall not revert to the
|
0006| general fund."
