0012| RELATING TO COURTS; PROVIDING FOR THREE ADDITIONAL JUDGES IN THE

0013| BERNALILLO COUNTY METROPOLITAN COURT; AMENDING SECTIONS OF THE
|
0014| NMSA 1978; MAKING AN APPROPRIATION.

0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. Section 34-8A-4.1 NMSA 1978 (being Laws 1981,
|
0018| Chapter 318, Section 2, as amended) is amended to read:
|
0019| "34-8A-4.1. METROPOLITAN COURT JUDGES--TERMS OF OFFICE--ELECTION.--
|
0020| A. The elected term of office for each judge of the
|
0021| metropolitan court is four years.
|
0022| B. Judges of the metropolitan court who have been
|
0023| previously elected in a partisan election or who were serving as
|
0024| metropolitan judges on January 1, 1989 in divisions one through
|
0025| twelve shall be subject to retention or rejection on a
|
0001| nonpartisan ballot at the 1990 general election for a four-year
|
0002| term ending December 31, 1994.
|
0003| C. Any person appointed to fill a vacancy on the
|
0004| metropolitan court after January 1, 1989 shall serve until the
|
0005| next general election. That person's successor shall be chosen
|
0006| at that general election and shall hold the office until the
|
0007| general election four years later.
|
0008| D. Judges of the Bernalillo county metropolitan
|
0009| court for divisions thirteen, fourteen and fifteen shall be
|
0010| appointed and shall serve until the 1992 general election.
|
0011| Their successors shall be chosen at that general election and
|
0012| shall hold office until the general election four years later.
|
0013| E. Judges of the Bernalillo county metropolitan
|
0014| court for divisions sixteen, seventeen and eighteen shall be
|
0015| appointed pursuant to Article 6, Section 37 of the constitution
|
0016| of New Mexico and shall serve until the 1998 general election.
|
0017| Their successors shall be chosen at that general election and
|
0018| shall hold office until the general election four years later."
|
0019| Section 2. Section 34-8A-8 NMSA 1978 (being Laws 1979,
|
0020| Chapter 346, Section 8, as amended) is amended to read:
|
0021| "34-8A-8. METROPOLITAN COURT--BERNALILLO DISTRICT.--
|
0022| A. The name of the metropolitan court in the
|
0023| Bernalillo metropolitan district shall be the "Bernalillo county
|
0024| metropolitan court".
|
0025| B. The metropolitan court is an agency of the
|
0001| judicial department of state government. Personnel of the
|
0002| metropolitan court are subject to all laws and regulations
|
0003| applicable to state officers and agencies and state officers and
|
0004| employees, except where otherwise specifically provided by law.
|
0005| C. There shall be [fifteen] eighteen judges of
|
0006| the Bernalillo county metropolitan court."
|
0007| Section 3. APPROPRIATION.--Six hundred ten thousand
|
0008| dollars ($610,000) is appropriated from the general fund to the
|
0009| Bernalillo county metropolitan court for expenditure in fiscal
|
0010| year 1997 for the purpose of paying salaries and benefits and
|
0011| providing furniture, equipment and supplies for three judges and
|
0012| support staff. Any unexpended or unencumbered balance remaining
|
0013| at the end of fiscal year 1997 shall revert to the general fund.
|
0014| Section 4. EFFECTIVE DATE.--The effective date of the
|
0015| provisions of this act is July 1, 1996.

0021| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|

0014| "34-6-5. JUDGES--SECOND JUDICIAL DISTRICT.--There shall be
|
0015| [twenty-one] twenty-two district judges in the second judicial
|
0016| district."
|
0017| Section 4. TEMPORARY PROVISION--APPOINTMENT.--The additional
|
0018| judgeship provided for in Section 3 of this act shall be filled by
|
0019| the governor pursuant to Article 6, Section 36 of the constitution
|
0020| of New Mexico.
|
0021| Section 5. APPROPRIATION--BERNALILLO COUNTY METROPOLITAN
|
0022| COURT.--Six hundred ten thousand dollars ($610,000) is appropriated
|
0023| from the general fund to the Bernalillo county metropolitan court
|
0024| for expenditure in fiscal year 1997 for the purpose of paying
|
0025| salaries and benefits and providing furniture, equipment and
|
0001| supplies for three judges and support staff. Any unexpended or
|
0002| unencumbered balance remaining at the end of fiscal year 1997 shall
|
0003| revert to the general fund.
|
0004| Section 6. APPROPRIATION--SECOND JUDICIAL DISTRICT.--Two

0005| hundred twenty-six thousand dollars ($226,000) is appropriated from

0006| the general fund to the second judicial district for expenditure in
|
0007| fiscal year 1997 for the purpose of paying salaries and benefits
|
0008| and providing equipment, furniture and supplies for one additional
|
0009| children's court judge and support staff. Any unexpended or
|
0010| unencumbered balance remaining at the end of fiscal year 1997 shall
|
0011| revert to the general fund.
|
0012| Section 7. EFFECTIVE DATE.--The effective date of the
|
0013| provisions of this act is July 1, 1996.
