AN ACT

RELATING TO THE ENVIRONMENT; PROHIBITING THE CONSTRUCTION OF NEW SOURCES OF EMISSIONS AND ACTIVITIES RELATING TO OIL AND GAS IN COUNTIES WHERE OZONE CONCENTRATIONS ARE IN EXCESS OF THE PRIMARY NATIONAL AMBIENT AIR QUALITY STANDARDS FOR OZONE.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of the Air Quality Control Act is enacted to read:

     "[NEW MATERIAL] PROHIBITION ON THE CONSTRUCTION OF NEW SOURCES RELATING TO OIL AND GAS IN COUNTIES WHERE OZONE CONCENTRATIONS ARE IN EXCESS OF THE PRIMARY NATIONAL AMBIENT AIR QUALITY STANDARDS FOR OZONE.--Beginning July 1, 2025, the department and a local agency shall prohibit the construction of a new source relating to oil and gas production in a county where the environmental improvement board or the local agency determines that emissions from sources in a county within the environmental improvement board's jurisdiction or the local authority's jurisdiction cause or contribute to ozone concentrations in excess of the primary national ambient air quality standard for ozone as promulgated pursuant to the federal Clean Air Act or its subsequent amendments and successor provisions."
