AN ACT

RELATING TO BEHAVIORAL HEALTH; CREATING THE LONG-TERM RESIDENTIAL REHABILITATION CENTER TO PROVIDE SUBSTANCE USE TREATMENT TO PEOPLE WHO ARE ADDICTED TO DRUGS AND ALCOHOL; MAKING AN APPROPRIATION TO THE PURCHASING DIVISION OF THE GENERAL SERVICES DEPARTMENT TO PURCHASE A FACILITY THAT WILL BECOME THE LONG-TERM RESIDENTIAL REHABILITATION CENTER.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of Chapter 23 NMSA 1978 is enacted to read:

     "[NEW MATERIAL] SHORT TITLE.--This act may be cited as the "Long-Term Residential Rehabilitation Center Act"."

     SECTION 2. A new section of Chapter 23 NMSA 1978 is enacted to read:

     "[NEW MATERIAL] LONG-TERM RESIDENTIAL REHABILITATION CENTER--CREATION.--The "long-term residential rehabilitation center" is created. The long-term residential rehabilitation center shall provide up to eighteen months of residential substance use treatment to people who are addicted to drugs and alcohol."

     SECTION 3. A new section of Chapter 23 NMSA 1978 is enacted to read:

     "[NEW MATERIAL] LONG-TERM RESIDENTIAL REHABILITATION CENTER ADMINISTRATION.--

          A. The long-term residential rehabilitation center shall be under the administration and control of the department of health. The secretary of health shall ensure that the long-term residential rehabilitation center obtains the licensure and accreditation necessary to operate.

          B. The long-term residential rehabilitation center may accept donations, gifts or bequests of land, money or things of value for the establishment, maintenance and advancement of the long-term residential rehabilitation center. Title to lands acquired shall be vested in the state. Donations, gifts and bequests of money shall be deposited to the credit of the long-term residential rehabilitation center if required as a condition of the donation, gift or bequest."

     SECTION 4. APPROPRIATION.--Sixteen million dollars ($16,000,000) is appropriated from the general fund to the purchasing division of the general services department for expenditure in fiscal year 2025 to purchase a facility in Albuquerque for the purpose of converting the facility into the long-term residential rehabilitation center. Any unexpended or unencumbered balance remaining at the end of fiscal year 2025 shall revert to the general fund.

     SECTION 5. CONTINGENT EFFECTIVE DATE--NOTIFICATION.--The provisions of this act become effective upon the purchasing division of the general services department's purchase of a facility that the department of health intends to use as the long-term residential rehabilitation center. When the purchasing division purchases the facility, the state purchasing agent shall notify the New Mexico compilation commission and the director of the legislative council service of the purchase.
