A JOINT RESOLUTION
RATIFYING AND APPROVING THE DONATION BY THE FACILITIES MANAGEMENT DIVISION OF THE GENERAL SERVICES DEPARTMENT TO VALENCIA COUNTY OF REAL PROPERTY LOCATED AT 1835 HIGHWAY 314 SOUTHWEST IN LOS LUNAS.
WHEREAS, Section 13-6-2 NMSA 1978 provides that a state agency may sell or otherwise dispose of real property by competitive sealed bid, public auction or negotiated sale to a private person or to other entities; and
WHEREAS, Section 13-6-3 NMSA 1978 provides in pertinent part that any sale, trade or lease of real property belonging to a state agency for consideration of one hundred thousand dollars ($100,000) or more shall be subject to the ratification and approval by the state legislature prior to the sale, trade or lease becoming effective; and
WHEREAS, the facilities management division of the general services department holds the title to approximately eleven acres located at 1835 highway 314 southwest in Los Lunas ("subject property") but is not using or planning a use for it; and
WHEREAS, the subject property proposed for donation is described as follows:
Eleven acres of Tax Parcel #1-009-037-086-055-000000 further described as Tract: 2B 1 A1 S: 33 T: 7N R: 2E 46.29 ACRES MAP 80, LESS AND EXCEPT VALENCIA COUNTY COURTHOUSE PARCEL (R301574); and
WHEREAS, the value of the subject property has been appraised at two hundred ninety-five thousand dollars ($295,000); and
WHEREAS, Valencia county has agreed to accept ownership of the subject property at no cost; and
WHEREAS, Valencia county has agreed that if it ever decides that the subject property is no longer needed for any county purpose and should be disposed of, at the option of the state and at no cost to the state, the county will transfer ownership of the subject property back to the state;
NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE
STATE OF NEW MEXICO that the donation of the subject property as described above from the facilities management division of the general services department to Valencia county at no cost be hereby ratified and approved by the legislature; and
BE IT FURTHER RESOLVED that copies of this resolution be transmitted to the facilities management division of the general services department and to the board of county commissioners of Valencia county.
