AN ACT

RELATING TO THE PUBLIC PEACE, HEALTH, SAFETY AND WELFARE; ENACTING THE ROUTE 66 CENTENNIAL COMMISSION ACT; CREATING THE ROUTE 66 CENTENNIAL COMMISSION; CREATING THE ROUTE 66 CENTENNIAL COMMISSION FUND; ESTABLISHING DUTIES AND POWERS OF THE COMMISSION; PROVIDING A DELAYED REPEAL.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. [NEW MATERIAL] SHORT TITLE.--This act may be cited as the "Route 66 Centennial Commission Act".

     SECTION 2. [NEW MATERIAL] DEFINITIONS.--As used in the Route 66 Centennial Commission Act:

          A. "commission" means the route 66 centennial commission; and

          B. "department" means the tourism department.

     SECTION 3. [NEW MATERIAL] ROUTE 66 CENTENNIAL COMMISSION CREATED--MEMBERS.--The "route 66 centennial commission" is created in the department and shall be dissolved on June 30, 2027. Its members shall reflect the various interests, history and importance of the communities along route 66 in New Mexico. The commission is composed of the following members:

          A. two public members appointed by the speaker of the house of representatives;

          B. two public members appointed by the minority floor leader of the house of representatives;

          C. two public members appointed by the president pro tempore of the senate;

          D. two public members appointed by the minority floor leader of the senate;

          E. three public members appointed by the governor, one of whom shall be appointed to serve as chair of the commission; and

          F. nine ex-officio members, including the:

                (1) governor, or the governor's designee;

                (2) secretary of tourism or the secretary's designee;

                (3) secretary of transportation or the secretary's designee;

                (4) director of the historic preservation division of the cultural affairs department or the director's designee;

                (5) secretary of energy, minerals and natural resources or the secretary's designee;

                (6) director of the financial institutions division of the regulation and licensing department or the director's designee;

                (7) state records administrator of the state records center and archives or the administrator's designee;

                (8) president of the route 66 association of New Mexico or the president's designee; and

                (9) executive director of the New Mexico route 66 national scenic byway or the executive director's designee.

     SECTION 4. [NEW MATERIAL] MEETINGS--QUORUM AND VOTING--MEMBER COMPENSATION--PER DIEM--EXPENSES.--

          A. The commission shall meet at least quarterly at a time and place designated by the chair of the commission.

          B. A majority of the members of the commission constitutes a quorum for transacting commission business.

          C. A public member of the commission shall receive per diem and mileage as provided in the Per Diem and Mileage Act and shall receive no other compensation, perquisite or allowance.

     SECTION 5. [NEW MATERIAL] POWERS AND DUTIES.--The commission shall:

          A. plan and sponsor official route 66 centennial events, programs and activities in New Mexico;

          B. encourage the development of programs designed to involve all residents in activities that commemorate route 66 centennial events in the state;

          C. make available to the public information on route 66 centennial events happening in the state, to the best of the commission's ability; and

          D. create and deliver to the governor by June 30, 2027, a final report on the commission's activities.

     SECTION 6. [NEW MATERIAL] FUND CREATED.--The "route 66 centennial commission fund" is created in the state treasury. The fund consists of transfers, appropriations, gifts, grants, donations, bequests, income from investment of the fund and other money distributed or otherwise allocated to the fund. The department shall administer the fund. Disbursements from the fund shall be made by warrant of the secretary of finance and administration pursuant to vouchers signed by the secretary of tourism. Money in the fund is subject to appropriation by the legislature to the department for the purposes of the Route 66 Centennial Commission Act. Money in the fund shall revert to the general fund at the end of fiscal year 2027.

     SECTION 7. DELAYED REPEAL.--Sections 1 through 6 of this act are repealed effective July 1, 2027.
