AN ACT

RELATING TO PUBLIC ASSISTANCE; REQUIRING MEDICAID APPLICANTS TO PROVIDE PROOF OF RESIDENCY.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of the Public Assistance Act is enacted to read:

     "[NEW MATERIAL] MEDICAID APPLICANT RESIDENCY REQUIREMENTS.--To be eligible for medicaid, an applicant shall be living in New Mexico on the date the medicaid application is submitted and shall provide at least two of the following documents that include the applicant's name and principal residence:

          A. a current real property rental agreement or a purchase agreement;

          B. a utility bill that is dated within sixty days of the application and that is not a cellular phone bill;

          C. an insurance bill, card or binder that is dated within the past six months of the application;

          D. a bank or credit card statement that is dated within sixty days of the application;

          E. an employment pay stub containing the applicant's name and address that is dated within sixty days of the application;

          F. a local property tax statement from the county assessor's office of the county where the property is located;

          G. documentation from an educational institution, such as a transcript, report card or enrollment confirmation that is dated within sixty days of the application;

          H. original documentation from a municipal, county, state, tribal or federal government organization or community organization attesting to the applicant's New Mexico residency;

          I. a New Mexico medical or public assistance card with the applicant's address on the card, a letter from the issuing agency that came with the card that shows the applicant's name and address or the applicant's profile print-out from the issuing agency;

          J. documents indicating membership in a New Mexico religious organization; provided that the applicant is less than eighteen years of age;

          K. documents indicating membership in a New Mexico sports organization; provided that the applicant is less than eighteen years of age;

          L. if the applicant is less than eighteen years of age, an affidavit from the applicant's parent or guardian stating that the applicant lives with the parent or guardian; provided that the affidavit is accompanied by the parent or guardian's New Mexico identification card or two documents that prove the residency of the parent or guardian; or

          M. a document evidencing eligibility and proof that the applicant is currently receiving services from a nonprofit organization, qualified pursuant to Section 501(c)(3) of the federal Internal Revenue Code of 1986; provided that the document displays the applicant's address."
