AN ACT

RELATING TO TIME; EXEMPTING NEW MEXICO FROM THE FEDERAL LAW REQUIRING THE OBSERVANCE OF DAYLIGHT SAVING TIME.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. [NEW MATERIAL] FINDINGS.--The legislature

finds that:

          A. the state of New Mexico is entirely situated within one federally established time zone;

          B. the federal Uniform Time Act of 1966, Public Law

89-387, provides for the advancement of standard time by one hour during a portion of each year, a period commonly known as "daylight saving time"; and

          C. federal law permits a state that is entirely situated within one time zone to exempt itself by law from the requirement to advance time for daylight saving; provided that the exemption applies to the entire state.

     SECTION 2. [NEW MATERIAL] MOUNTAIN STANDARD TIME--NO ADVANCEMENT FOR DAYLIGHT SAVING.--Effective January 1, 2024,

the entire state of New Mexico shall:

          A. be exempted from federal law that requires advancing time for daylight saving; and

          B. throughout the year observe mountain standard time without the advancement of time for daylight saving.
