    Your JUDICIARY COMMITTEE, to whom has been referred

 

SENATE JUDICIARY COMMITTEE SUBSTITUTE FOR

SENATE BILL 42

 

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

 

     1. On page 1, line 12, after the semicolon, insert "REVISING THE REPORTING SCHEDULE FOR EXPENDITURES AND CONTRIBUTIONS; STANDARDIZING THE SUPPLEMENTAL REPORTING REQUIREMENTS FOR ALL ELECTIONS TO INCLUDE ANY CONTRIBUTION OR PLEDGE FOR ONE THOUSAND DOLLARS ($1,000) OR MORE; REQUIRING THE REPORTING OF MONETARY CONTRIBUTIONS RECEIVED DURING THE LEGISLATIVE SESSION FUNDRAISING PROHIBITION PERIOD;".

 

     2. On page 14, line 16, strike "Monday in April and October" and insert in lieu thereof "Tuesday after the first Monday in June and January 7".

 

     3. On page 14, line 18, strike "Monday in those months" and insert in lieu thereof "Tuesday after the first Monday in June and December 31, respectively,".

 

     4. On page 14, line 22, strike "F or" and remove the brackets and the line through "or H".

 

     5. On page 16, line 3, strike "more than".

 

     6. On page 16, lines 4 and 5, strike "in a nonstatewide election, or more than three thousand dollars ($3,000) in a statewide election," and insert in lieu thereof "or more".

 

     7. On page 16, line 14, strike "thirtieth" and insert in lieu thereof "seventh".

 

     8. On page 16, line 18, strike "twenty-fifth day after" and insert in lieu thereof "day of".

 

     9. On page 16, line 24, strike "and".

 

     10. On page 16, between lines 24 and 25, insert the following new paragraph:

 

                "(8) no later than the seventh day after a general election, a report of all expenditures made and contributions received on or before the day of the general election and not previously reported; and".

 

     11. Renumber the succeeding paragraph accordingly.

 

     12. On page 17, between lines 3 and 4, insert the following new subsection:

 

          "C. If a reporting individual is subject to the legislative session fundraising prohibition of Section 1-19-34.1 NMSA 1978 and receives monetary contributions during a prohibited period, the reporting individual shall file a report of all of the monetary contributions received but not returned during the prohibited period no later than the seventh day after the ending of the prohibited period.".

 

     13. Reletter the succeeding subsections accordingly.
