AN ACT

RELATING TO WOMEN'S HEALTH CARE; ESTABLISHING STANDARDS OF CARE.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. [NEW MATERIAL] STANDARDS OF CARE FOR INDUCED ABORTIONS.--

          A. A facility that provides abortions shall adhere to the same standards of care that are applied to other types of surgical clinics.

          B. A health care provider who performs abortions shall maintain the same level of malpractice insurance as health care providers who work at facilities that provide obstetrics and gynecology services.

          C. A facility that provides abortions shall have:

                (1) emergency care staff and equipment on-site; or

                (2) admitting privileges at a nearby hospital.

          D. A facility or health care provider that performs an induced abortion on a pregnant woman shall ensure that the pregnant woman receives twenty-four-hour medical care throughout the procedure and until the procedure is complete, the fetus is fully extracted or expelled and the woman may safely be discharged from the facility or health care provider.

          E. A facility or health care provider shall not use digoxin or potassium chloride to perform an induced abortion.

     SECTION 2. [NEW MATERIAL] DEFINITIONS.--As used in Section 1 of this 2023 act:

          A. "facility or health care provider" means a person or entity licensed by the public health division of the department of health; and

          B. "induced abortion" means an abortion procedure that:

                (1) uses drugs to induce a pregnant woman into premature labor for the purpose of expelling a fetus from the pregnant woman; and

                (2) uses digoxin or potassium chloride to inject the heart of a fetus with the intent to stop the fetus's heartbeat and terminate the life of the fetus over a twenty-four-hour period and prior to expulsion from a pregnant woman.
