AN ACT
RELATING TO HIGHER EDUCATION; REQUIRING A MINIMUM COMPENSATION FOR FULL-TIME OR PART-TIME FACULTY AT PUBLIC POST-SECONDARY EDUCATIONAL INSTITUTIONS; MAKING AN APPROPRIATION.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
SECTION 1. A new section of Chapter 21 NMSA 1978 is enacted to read:
"[NEW MATERIAL] MINIMUM COMPENSATION AT PUBLIC POST-SECONDARY EDUCATIONAL INSTITUTIONS FOR FULL-TIME OR PART-TIME FACULTY.--
A. As used in this section:
(1) "appointment percentage" means the percentage of the total amount of effort expected of a full-time or part-time faculty member with the same or similar title and rank;
(2) "full-time faculty" means an employee at a public post-secondary educational institution, including adjuncts, instructors, professors, lecturers, clinician- educators and term teachers, with a full-time appointment;
(3) "nine-month contract" means a contract to work from the fall semester through the spring semester;
(4) "part-time faculty" means an employee at a public post-secondary educational institution, including adjuncts, instructors, professors, lecturers, clinician- educators and term teachers, with a part-time appointment;
(5) "three-term contract" means a contract to work through the fall, spring and summer semesters; and
(6) "twelve-month contract" means a contract to work through the full calendar year.
B. The minimum compensation for full-time faculty at a public post-secondary educational institution shall be:
(1) twenty-six thousand dollars ($26,000) when appointed to a single fall, spring or summer semester contract;
(2) fifty-two thousand dollars ($52,000) when appointed to a nine-month contract; or
(3) seventy-eight thousand dollars ($78,000) when appointed to a twelve-month or three-term contract.
C. The minimum compensation for part-time faculty employed at a public post-secondary educational institution shall be determined by multiplying the appointment percentage of the contract by:
(1) twenty-six thousand dollars ($26,000) when appointed to a single fall, spring or summer semester contract; or
(2) fifty-two thousand dollars ($52,000) when appointed to a nine-month contract."
SECTION 2. APPROPRIATION.--Thirty million dollars ($30,000,000) is appropriated from the general fund to the higher education department for expenditure in fiscal year 2024 to meet the compensation needs of full-time and part-time faculty at public post-secondary educational institutions. Any unexpended or unencumbered balance remaining at the end of fiscal year 2024 shall revert to the general fund.
SECTION 3. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2023.
