Mr. President:

    Your JUDICIARY COMMITTEE, to whom has been referred

HOUSE BILL 179, as amended

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

    1. Strike Item 3 of House Floor Amendment number 1.

    2. On page 2, lines 19 and 20, strike "A copy of the claim for

a lien shall be attached to the notice." and insert in lieu thereof:

"The copy of the filed claim for a lien shall be sent or delivered

to the owner or reputed owner at the owner or reputed owner's last

known address. If the owner or reputed owner's address is not

known, the copy of the filed claim for a lien shall be sent to the

address of the owner of the property as listed in the county

assessor's files. The failure of the claimant to serve the notice may preclude the recovery of interest, attorney's fees or costs."
