AN ACT

RELATING TO CAMPAIGNS; PROHIBITING THE SOLICITATION OF MONEY FOR A LEGISLATOR'S OR THE GOVERNOR'S ELECTION OR REELECTION TO ANY PUBLIC OFFICE DURING A LEGISLATIVE SESSION; DECLARING AN EMERGENCY.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of Chapter 1 NMSA 1978 is enacted to read:

     "[NEW MATERIAL] PROHIBITED FUNDRAISING PERIOD FOR LEGISLATORS AND GOVERNOR.--In addition to the legislative session fundraising prohibitions of the Campaign Reporting Act:

          A. it is unlawful during the period beginning January 1 prior to any regular session of the legislature or, in the case of a special session, after the proclamation has been issued, and ending on adjournment of the regular or special session, for a person serving as a legislator to knowingly solicit money for the person's election or reelection to any public office; and

          B. it is unlawful during the period beginning January 1 prior to any regular session of the legislature or, in the case of a special session, after the proclamation has been issued, and ending the twentieth day following the adjournment of the regular or special session, for a person serving as the governor to knowingly solicit money for the person's election or reelection to any public office."

     SECTION 2. EMERGENCY.--It is necessary for the public peace, health and safety that this act take effect immediately.
