AN ACT

RELATING TO CRIME; CREATING THE CRIME OF VEHICULAR MANSLAUGHTER.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of the Motor Vehicle Code is enacted to read:

     "[NEW MATERIAL] VEHICULAR MANSLAUGHTER.--

          A. Vehicular manslaughter consists of the killing of a human being, without malice, in the unlawful operation of a motor vehicle while committing a crime that is not classified as a felony, but that not does not include a misdemeanor for:

                (1) driving under the influence of intoxicating liquor or drugs pursuant to Section 66-8-201 NMSA 1978;

                (2) reckless driving pursuant to Section 66-8-113 NMSA 1978; or

                (3) resisting, evading or obstructing an officer pursuant to Section 30-22-1 NMSA 1978.

          B. A person who commits vehicular manslaughter is guilty of a fourth degree felony and shall be sentenced pursuant to the provisions of Section 31-18-15 NMSA 1978."
