AN ACT

RELATING TO THE GENERAL APPROPRIATION ACT; REQUIRING PUBLICATION OF THE LIST OF LEGISLATORS, STATE AGENCIES AND THE GOVERNOR WHO PROPOSED ADDITIONS AND DELETIONS, INCLUDING LANGUAGE, ADOPTED FOR THE GENERAL APPROPRIATION ACT; DECLARING AN EMERGENCY.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of Chapter 2, Article 5 NMSA 1978 is enacted to read:

     "[NEW MATERIAL] GENERAL APPROPRIATION ACT ADDITIONS AND DELETIONS--LEGISLATORS, STATE AGENCIES AND GOVERNOR--PUBLICATION.--

          A. Beginning with the first session of the fifty-fifth legislature, the legislative finance committee shall publish on the legislative website a searchable list of general appropriation act additions and deletions, including language, that passed the legislature and the name of the legislator, state agency or the governor who proposed the addition or deletion to the general appropriation act and the amount of the addition or deletion, if applicable. The general appropriation list, including vetoes, shall be published within seventy-two hours after the governor has acted on the general appropriation act or after the general appropriation act has failed to become law pursuant to Article 4, Section 22 of the constitution of New Mexico because the governor failed to approve and sign that bill.

          B. The additions and deletions, including language, shall be those items proposed by legislators, state agencies or the governor and accepted by committees or adopted by legislative bodies at every stage of bill passage from the first committee through conference committee.

          C. The legislative finance committee shall provide paper copies of the web-based publication, if requested.

          D. As used in this section, "general appropriation act" means the legislative-finance-committee-prepared general appropriation act, if introduced; that committee's budget recommendations if a committee bill is not introduced; or other bill that is used as the base for the development of that year's general appropriation act."

     SECTION 2. EMERGENCY.--It is necessary for the public peace, health and safety that this act take effect immediately.
