HOUSE FLOOR AMENDMENT number ___1__ to HOUSE BILL 145

Amendment sponsored by Representative Meredith Dixon

    1. On page 1, lines 11 through 13, strike "CREATING THE CRIME OF ILLEGALLY DISMANTLING A MOTOR VEHICLE, VEHICLE, STOLEN MOTOR VEHICLE OR STOLEN VEHICLE" and insert in lieu thereof "PROHIBITING OPERATION OF A CHOP SHOP".

 

    2. On page 1, lines 18 and 19, strike "ILLEGALLY DISMANTLING A MOTOR VEHICLE, VEHICLE, STOLEN MOTOR VEHICLE OR STOLEN VEHICLE" and insert in lieu thereof "OPERATING A CHOP SHOP".

    3. On page 1, lines 20 through 25 and page 2, line 1, strike Subsections A and B in their entirety and insert in lieu thereof the following subsection:

         "A. Any person who knowingly owns, operates, maintains or controls a chop shop or conducts operations in a chop shop is guilty of a third degree felony.".

    4. Reletter the succeeding subsections accordingly.

    5. On page 2, lines 3 through 16, strike Paragraph (1) in its entirety and insert in lieu thereof the following paragraph:

 

             "(1) "chop shop" means any building, lot, facility or other structure or premises where one or more persons engage in receiving, concealing, destroying, disassembling, dismantling, reassembling or storing any motor vehicle, motor vehicle part, vehicle or vehicle part that has been unlawfully obtained in order to alter, counterfeit, deface, destroy, disguise, falsify, forge, obliterate or remove the identity, including the vehicle identification number or derivative thereof, of the motor vehicle, motor vehicle part, vehicle or vehicle part and to distribute, sell or dispose of the motor vehicle, motor vehicle part, vehicle or vehicle part;".
