AN ACT

RELATING TO THE PUBLIC PEACE, HEALTH, SAFETY AND WELFARE; MAKING AN APPROPRIATION TO THE INDIAN AFFAIRS DEPARTMENT FOR LIBRARY AND INTERNET ACCESS PROJECTS FOR INDIAN NATIONS, TRIBES AND PUEBLOS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. APPROPRIATION.--

          A. Thirty-six million forty-three thousand one hundred twenty-two dollars ($36,043,122) is appropriated from the general fund to the Indian affairs department for expenditure in fiscal years 2019 through 2023 for the following purposes:

                (1) twenty-seven million three hundred ninety-three thousand one hundred twenty-two dollars ($27,393,122) to plan, design, renovate, expand, construct, equip and furnish libraries statewide for Indian nations, tribes and pueblos as follows:

                     (a) the Pueblo of Acoma in Cibola county, four million five hundred thousand dollars ($4,500,000);

                     (b) the Pueblo of Cochiti in Sandoval county, nine hundred seventy-five thousand dollars ($975,000);

                     (c) the Pueblo of Isleta in Bernalillo, Torrance and Valencia counties, five hundred thousand dollars ($500,000);

                     (d) the Pueblo of Jemez in Sandoval county, one million five hundred thousand dollars ($1,500,000);

                     (e) Kewa Pueblo in Sandoval county, one million five hundred thousand dollars ($1,500,000);

                     (f) the Pueblo of Laguna in Bernalillo, Cibola and Sandoval counties, six hundred fifty-eight thousand one hundred twenty-two dollars ($658,122);

                     (g) the Pueblo of Nambe in Santa Fe county, one million one hundred thousand dollars ($1,100,000);

                     (h) Ohkay Owingeh in Rio Arriba county, one million seven hundred thousand dollars ($1,700,000);

                     (i) the Pueblo of Picuris in Taos county, one million one hundred thousand dollars ($1,100,000);

                     (j) the Pueblo of Pojoaque in Santa Fe county, one million five hundred thousand dollars ($1,500,000);

                     (k) the Pueblo of Sandia in Sandoval and Bernalillo counties, nine hundred ten thousand dollars ($910,000);

                     (l) the Pueblo of San Felipe in Sandoval county, one million two hundred thousand dollars ($1,200,000);

                     (m) the Pueblo of San Ildefonso in Santa Fe county, five hundred thousand dollars ($500,000);

                     (n) the Pueblo of Santa Clara in Rio Arriba, Santa Fe and Sandoval counties, one million two hundred thousand dollars ($1,200,000);

                     (o) the Pueblo of Taos in Taos county, one million one hundred thousand dollars ($1,100,000);

                     (p) the Pueblo of Tesuque in Santa Fe county, one million five hundred thousand dollars ($1,500,000);

                     (q) the Pueblo of Zia in Sandoval county, one million one hundred thousand dollars ($1,100,000);

                     (r) the Pueblo of Zuni in McKinley county, one million four hundred thousand dollars ($1,400,000);

                     (s) the Torreon-Star Lake chapter of the Navajo Nation in Sandoval county, one million two hundred thousand dollars ($1,200,000);

                     (t) the Jicarilla Apache Nation in Rio Arriba county, six hundred fifty thousand dollars ($650,000); and

                     (u) the Mescalero Apache Tribe in Otero county, one million six hundred thousand dollars ($1,600,000);

                (2) four million six hundred thousand dollars ($4,600,000) to provide matching funds for high-speed internet access and telecommunications for schools and libraries for:

                     (a) the Pueblo of Jemez in Sandoval county;

                     (b) the Pueblo of Cochiti in Sandoval county;

                     (c) the Pueblo of San Felipe in Sandoval county;

                     (d) the Pueblo of Santa Ana in Sandoval county; and

                     (e) Kewa Pueblo in Sandoval county;

                (3) three million two hundred thousand dollars ($3,200,000) for high-speed internet access on the Navajo Nation;

                (4) twenty-five thousand dollars ($25,000) to each of the following entities for white space internet access:

                     (a) the Pueblo of Acoma in Cibola county;

                     (b) the Pueblo of Cochiti in Sandoval county;

                     (c) the Pueblo of Jemez in Sandoval county;

                     (d) the Jicarilla Apache Nation in Rio Arriba county;

                     (e) the Pueblo of Laguna in Bernalillo, Cibola and Sandoval counties;

                     (f) the Mescalero Apache Tribe in Otero county;

                     (g) Ohkay Owingeh in Rio Arriba county;

                     (h) the Pueblo of San Ildefonso in Santa Fe county;

                     (i) the Pueblo of Pojoaque in Santa Fe county;

                     (j) the Pueblo of Santa Clara in Rio Arriba, Santa Fe and Sandoval counties;

                     (k) the Torreon-Star Lake chapter of the Navajo Nation in Sandoval county;

                     (l) the Pueblo of Zuni in McKinley county;

                     (m) Diné college in Shiprock; and

                     (n) San Juan college in Farmington; and

                (5) five hundred thousand dollars ($500,000) for high-speed internet access on the Jicarilla Apache Nation.

          B. Any unexpended or unencumbered balance of an

appropriation made for a project pursuant to this section shall

revert to the tribal infrastructure project fund within six months of completion of the project, but no later than fiscal year 2023.
