AN ACT

RELATING TO CAPITAL EXPENDITURES; REQUIRING PUBLICATION OF ALLOCATIONS BY LEGISLATORS AND THE GOVERNOR OF CAPITAL OUTLAY APPROPRIATIONS OR BOND AUTHORIZATIONS; DECLARING AN EMERGENCY.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of Chapter 2, Article 3 NMSA 1978 is enacted to read:

     "[NEW MATERIAL] CAPITAL OUTLAY EXPENDITURE ALLOCATIONS--LEGISLATORS AND GOVERNOR--PUBLICATION.--

          A. Notwithstanding the provisions of Section 2-3-13 NMSA 1978, beginning with the first session of the fifty-fourth legislature, the legislative council service shall publish on the legislative website a searchable list of capital projects that passed the legislature and the names of legislators or the governor who allocated a portion of the capital outlay appropriation or bond authorization for each project and the amount of the allocation designated by each legislator and the governor. The capital projects list, including vetoes, shall be published within seventy-two hours after the governor has acted on the capital outlay bill or after the capital outlay bill has failed to become law pursuant to Article 4, Section 22 of the constitution of New Mexico because the governor failed to approve and sign that bill.

          B. The legislative council service shall provide paper copies of the web-based publication if requested."

     SECTION 2. EMERGENCY.--It is necessary for the public peace, health and safety that this act take effect immediately.
