Mr. President:
Your CORPORATIONS AND TRANSPORTATION COMMITTEE, to whom has been referred
HOUSE CONSUMER & PUBLIC AFFAIRS COMMITTEE SUBSTITUTE FOR HOUSE BILL 205
has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:
1. On page 2, line 22, strike "division" and insert in lieu thereof "appropriate authority having jurisdiction".
2. On page 2, line 23, strike "division" and insert in lieu thereof "authority having jurisdiction" and strike "issue a certificate of occupancy" and insert in lieu thereof "approve drawings and submittal documents".
3. On page 3, line 1, after the period, insert:
"No certificate of occupancy shall be issued for new construction of a place of public accommodation unless fully compliant with the provisions of this section.".
4. On page 3, lines 6 through 11, strike Subsection F in its entirety.
5. Reletter the succeeding subsection accordingly.
6. On page 3, between lines 12 and 13, insert the following new paragraph:
"(1) "authority having jurisdiction" means the state or a municipality, county or other political subdivision that has a full-service building department employing a full-time certified building official and has permitting, inspection and enforcement authority over the general construction, electrical and mechanical-plumbing trades within its jurisdiction;".
7. Renumber the succeeding paragraphs accordingly.
