AN ACT

RELATING TO CRIME; INCLUDING THE THREAT TO IMPAIR THE INTEGRITY OR AVAILABILITY OF INFORMATION IN THE LIST OF THREATS CONSIDERED EXTORTION.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. Section 30-16-9 NMSA 1978 (being Laws 1963, Chapter 303, Section 16-8) is amended to read:

     "30-16-9. EXTORTION.--

          A. Extortion consists of the communication or transmission of [any] a threat to another by any means whatsoever with intent [thereby] to wrongfully obtain anything of value or to wrongfully [compell] compel the person threatened to do or refrain from doing [any] an act against [his] the person's will.

          B. Any of the following acts shall be sufficient to constitute a threat under this section:

                [A.] (1) a threat to do an unlawful injury to the person or property of the person threatened or of another;

                [B.] (2) a threat to accuse the person threatened or another of any crime;

                [C.] (3) a threat to expose or impute to the person threatened or another [any] a deformity or disgrace;

                [D.] (4) a threat to expose [any] a secret affecting the person threatened or another; [or

                E.] (5) a threat to kidnap the person threatened or another; and

                (6) a threat to impair the integrity or availability of information that is stored on, processed by or transiting on an information system owned or operated by the person threatened or another.

          C. Whoever commits extortion is guilty of a third degree felony."
