AN ACT
RELATING TO PUBLIC SAFETY; CREATING THE MISSING MINOR ADVISORY.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
SECTION 1. A new section of the Missing Persons Information and Reporting Act is enacted to read:
"[NEW MATERIAL] MISSING MINOR ADVISORY.--
A. The department of public safety shall issue a missing minor advisory if the missing person is under sixteen years old and a missing person report has been filed on the missing person's behalf.
B. The department shall develop and implement missing minor advisory procedures for the purpose of disseminating, as rapidly as possible, information about a missing person under sixteen years old. The procedures shall include:
(1) notification to the lead station of the missing minor advisory;
(2) notification to other public and private media sources and members of the public as necessary;
(3) notification to a representative of each cellular service company and paging service company operating in New Mexico so that a text message may be sent to the companies' customers at no additional expense to the recipient or to any service that accepts the information from the authorized requester and delivers it to the cellular service or paging service company; and
(4) providing information about the missing person under sixteen years old, including all identifying information, to the lead station and other media sources and the cellular service companies and paging service companies operating in New Mexico."
SECTION 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2018.
