AN ACT

RELATING TO LIVESTOCK; ENACTING A NEW SECTION OF THE LIVESTOCK CODE TO PROVIDE FOR DISPOSITION OF HORSES THAT TRESPASS ON PRIVATE LAND.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of The Livestock Code is enacted to read:

     "[NEW MATERIAL] TRESPASSING HORSES ON PRIVATE LAND--BOARD JURISDICTION.--The board shall have jurisdiction over any horse that is in trespass on fee simple private land. The board shall attempt to determine ownership of a trespassing horse that is confiscated and simultaneously notify animal rescue organizations. If no owner can be identified after five days, the horse shall be offered to animal rescue organizations. If no animal rescue organization assumes ownership after two days, the board may auction the horse."
