AN ACT

RELATING TO CRIMINAL LAW; ESTABLISHING THE CRIME OF CARGO THEFT; PRESCRIBING A PENALTY.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of the Criminal Code is enacted to read:

     "[NEW MATERIAL] CARGO THEFT--PENALTY.--

          A. Cargo theft consists of stealing any one or a combination of the following items of property when the total value of that property is one thousand dollars ($1,000) or more:

                (1) commercial goods conveyed by a vehicle;

                (2) a vehicle designed to convey commercial goods; and

                (3) a trailer or container designed to be hauled by a vehicle to convey commercial goods.

          B. Whoever commits cargo theft is guilty of a second degree felony and shall be sentenced, notwithstanding the provisions of Section 31-18-15 NMSA 1978, to nine years imprisonment and the payment of a fine in an amount up to the fair market value of the property stolen and the cost of recovering the property."
