AN ACT

RELATING TO REAL PROPERTY; PROHIBITING THE USE OF STATE LAND FOR THE CONSTRUCTION OF A NEW BARRIER ORDERED OR SOUGHT BY THE FEDERAL GOVERNMENT ON THE STATE'S BORDER WITH MEXICO; DECLARING AN EMERGENCY.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. [NEW MATERIAL] NO STATE LAND FOR A NEW BORDER BARRIER.--Beginning on the effective date of this section, no real property owned or held in trust by the state shall be used, sold, leased, eased, transferred or otherwise disposed of for use as a site for the construction of a new barrier ordered or sought by the federal government on the border of the state of New Mexico and the Mexican states of Chihuahua and Sonora. This section shall not prevent the construction of a barrier to prevent the movement of livestock.

     SECTION 2. EMERGENCY.--It is necessary for the public peace, health and safety that this act take effect immediately.
