    Your CORPORATIONS AND TRANSPORTATION COMMITTEE, to whom has been referred

SENATE BILL 214

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

    1. On page 1, line 15, before the period, insert "; PROVIDING EXCEPTIONS".

    2. On page 2, line 5, before the period, insert

"--EXCEPTIONS".

    3. On page 3, line 15, strike "Compensation" and insert in lieu thereof "Except as otherwise provided in this section, compensation".

    4. On page 3, lines 20 and 21, strike ", subject to the other requirements of this section".

    5. On page 4, between lines 19 and 20, insert the following new subsection:

         "G. An employer shall be barred from claiming a reduction in compensation pursuant to this section if, before the accident, the employer has actual or constructive knowledge of the worker's intoxication or influence and a reasonable opportunity to take appropriate measures in response to the intoxication or influence but fails to take those measures.".

    6. Reletter the succeeding subsections accordingly.,

and thence referred to the JUDICIARY COMMITTEE.
