AN ACT

RELATING TO HEALTH; PROVIDING FOR INSTRUCTION IN PSYCHOMOTOR SKILLS-BASED CARDIOPULMONARY RESUSCITATION AND THE USE OF AN AUTOMATED EXTERNAL DEFIBRILLATOR IN SCHOOLS; MAKING AN APPROPRIATION.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. [NEW MATERIAL] HEALTH SKILLS INSTRUCTION.--

          A. By September 1, 2016, the secretary of public education shall establish a program pursuant to which a local school district or state-chartered charter school may apply for funding to offer to students in grades seven through twelve training in psychomotor skills-based cardiopulmonary resuscitation and the use of an automated external defibrillator. The training shall include an instructional program that is nationally recognized and that is based on the most current national evidence-based emergency cardiovascular care guidelines for psychomotor skills-based cardiopulmonary resuscitation and the use of an automated external defibrillator.

          B. The secretary of public education shall adopt and promulgate rules for implementation of the provisions of this section, including rules to establish:

                (1) procedures for monitoring and ensuring compliance with the provisions of this section;

                (2) a process pursuant to which a local school district or state-chartered charter school may apply for and receive grants pursuant to Section 2 of this act; and

                (3) a process by which the department oversees that the grants made pursuant to this section are applied exclusively to the following purposes:

                     (a) psychomotor skills-based cardiopulmonary resuscitation and the use of an automated external defibrillator training;

                     (b) the purchase of materials necessary for implementation of psychomotor skills-based cardiopulmonary resuscitation and the use of an automated external defibrillator training;

                     (c) the temporary hiring of a cardiopulmonary resuscitation instructor or other training personnel to teach psychomotor skills-based cardiopulmonary resuscitation and the use of an automated external defibrillator; and

                     (d) any additional cost related to the training of psychomotor skills-based cardiopulmonary resuscitation and the use of an automated external defibrillator pursuant to this section.

          C. As used in this section, "psychomotor skills-based cardiopulmonary resuscitation training" means instruction in cardiopulmonary resuscitation that uses hands-on practice to support cognitive learning.SECTION 2. APPROPRIATION.--One hundred thousand dollars ($100,000) is appropriated from the general fund to the public education department for expenditure in fiscal year 2017 to fund instruction in psychomotor skills-based cardiopulmonary resuscitation and the use of an automated external defibrillator in schools pursuant to Section 1 of this act. Any unexpended or unencumbered balance remaining at the end of fiscal year 2017 shall revert to the general fund.
