AN ACT

RELATING TO CRIMINAL LAW; ESTABLISHING THE CRIME OF ABSCONDING FROM PROBATION OR PAROLE; ENACTING PENALTIES.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of the Criminal Code is enacted to read:

     "[NEW MATERIAL] ABSCONDING FROM PROBATION OR PAROLE.--

          A. Absconding from probation or parole consists of any probationer or parolee who, while under the supervision of the adult probation and parole division of the corrections department, changes residence or leaves the jurisdiction to which the probationer or parolee is restricted without permission and lacks a valid, legal excuse for not being available for supervision by the probation and parole officer working for the division.

          B. Whoever commits absconding from probation or parole is guilty of a fourth degree felony and shall be sentenced pursuant to the provisions of Section 31-18-15 NMSA 1978."
