AN ACT

RELATING TO HIGHER EDUCATION; PROVIDING THAT ARTICULATION, TRANSFER AND DUAL CREDIT AGREEMENTS BETWEEN PUBLIC POST-SECONDARY EDUCATIONAL INSTITUTIONS BE EXECUTED BY AUGUST 1, 2017.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. [NEW MATERIAL] ARTICULATION, TRANSFER AND DUAL CREDIT AGREEMENTS.--

          A. By August 1, 2016, the higher education department shall promulgate guidelines for each public post-secondary educational institution to develop articulation, transfer and dual enrollment agreements.

          B. By December 31, 2016, the board of regents or governing body of each public post-secondary educational institution shall develop articulation, transfer and dual enrollment agreements in conformance with the higher education department's guidelines and compliance with the provisions of Section 21-1B-3 NMSA 1978. By August 1, 2017, the board of regents or governing body of each public post-secondary educational institution shall execute such articulation, transfer and dual enrollment agreements with other public post-secondary educational institutions in the state.

          C. If a public post-secondary educational institution does not comply with the provisions of Subsection B of this section, the secretary of higher education may recommend to the legislative finance committee and the department of finance and administration that the next annual appropriation for instruction and general support for that institution be reduced by up to ten percent.
