AN ACT
RELATING TO RULES; ENACTING A NEW SECTION OF THE STATE RULES ACT; PROVIDING FOR THE EXPIRATION OF RULES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
SECTION 1. A new section of the State Rules Act is enacted to read:
"[NEW MATERIAL] EXPIRATION OF RULES--EXCEPTIONS.--Except for rules adopted by the taxation and revenue department, on July 1, 2020, all rules shall expire. Thereafter, any rule that is adopted shall expire on July 1 five years from the calendar year in which the rule was published in the New Mexico register, and the rule shall not be re-filed with the records center unless, prior to the expiration date, the issuing agency conducts a review of the rule to eliminate the rule if found to be no longer applicable, cost-effective, timely or necessary for the implementation of the agency's mission as provided by law. Nothing in this section shall be construed to preclude an agency from holding a public hearing regarding a rule if the agency deems the hearing necessary as part of the review of the rule. The provisions of this section do not apply to a rule adopted and filed within two years of the rule's expiration date."
SECTION 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2015.
