AN ACT

RELATING TO ENVIRONMENTAL REGULATION; ENACTING A NEW SECTION OF THE HAZARDOUS WASTE ACT; CREATING A FUND; MAKING AN APPROPRIATION.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of the Hazardous Waste Act is enacted to read:

     "[NEW MATERIAL] SAFE TRANSPORT OF HAZARDOUS MATERIALS FUND--CREATED--ADMINISTRATION--DISBURSEMENT.--

          A. The "safe transport of hazardous materials fund" is created in the state treasury. The fund shall consist of money appropriated, donated or otherwise accrued to the fund. The fund shall be administered by the department of finance and administration in consultation with the department of environment for the purpose of improving the design and structural safety of infrastructure used to transport hazardous materials throughout the state. Balances in the fund shall not revert to any other fund at the end of a fiscal year.

          B. Notwithstanding the provisions of Section 74-4-8 NMSA 1978, civil penalties assessed after November 30, 2014 and prior to January 1, 2016 pursuant to Sections 74-4-10 and 74-4-12 NMSA 1978 are appropriated to the safe transport of hazardous materials fund.

          C. Amounts in the safe transport of hazardous materials fund may be disbursed to any state agency for design, construction and maintenance projects pursuant to vouchers signed by the administrative head of that agency upon warrants drawn by the secretary of finance and administration."

     SECTION 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2015.
