Mr. Speaker:

    Your JUDICIARY COMMITTEE, to whom has been referred

HOUSE BILL 439

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

     1. On page 1, line 13, strike the semicolon and insert in lieu thereof a period, strike the remainder of the line and strike lines 14 through 17 in their entirety.

     2. On page 1, lines 23 and 24, strike "OR POLITICAL LEAVE".

     3. On page 2, line 1, strike "may" and insert in lieu thereof "shall".

     4. On page 2, line 2, after "or", strike the remainder of the line, strike lines 3 through 8 in their entirety and insert in lieu thereof "leave without pay on a day that the legislator attends a meeting for which the legislator is eligible to receive per diem pursuant to Article 4, Section 10 of the constitution of New Mexico.".

     5. On page 2, line 9, strike "Public employers" and insert in lieu thereof "Political subdivisions of the state".

     6. On page 2, line 10, after the comma, strike the remainder of the line, strike lines 11 through 13 in their entirety and insert in lieu thereof "shall require employees who are legislators to take accrued annual leave or compensatory leave or leave without pay on a day that the employee attends a meeting for which the employee is eligible to receive per diem as a legislator pursuant to Article 4, Section 10 of the constitution of New Mexico.".

     7. On page 2, strike lines 14 through 22 in their entirety and insert in lieu thereof:

          "C. An employee of a political subdivision of the state who is a legislator shall not lose seniority with the political subdivision due to leave the employee is required to take pursuant to this section. Leave taken pursuant to this section shall not be considered a break in service with the political subdivision for any purpose."".

and thence referred to the BUSINESS AND EMPLOYMENT COMMITTEE.
