    Your BUSINESS AND EMPLOYMENT COMMITTEE, to whom has been referred

HOUSE BILL 243

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

     1. On page 1, line 13, strike "A DEFINITION" and insert in lieu thereof "DEFINITIONS", and after "FOR", insert ""CIDER" AND".

     2. On page 2, between lines 18 and 19, insert the following new subsection:

          "D. "cider" means an alcoholic beverage made from the normal alcoholic fermentation of the juice of sound, ripe apples that contains not less than one-half of one percent alcohol by volume and not more than seven percent alcohol by volume;".

     3. Reletter the succeeding subsections accordingly.

     4. On page 27, line 11, strike "merchandise" and insert in lieu thereof "alcoholic beverages".

     5. On page 27, line 12, strike "merchandise has" and insert in lieu thereof "alcoholic beverages have".

     6. On page 27, line 13, strike "merchandise that is damaged," and insert in lieu thereof "alcoholic beverages that are".

     7. On page 27, lines 13 and 14, strike "otherwise unfit for consumption" and insert in lieu thereof "expiration date or that were damaged by the wholesaler, but not including a return of alcoholic beverages that were damaged by any other licensee or any other licensee's employees or customers".,

and thence referred to the JUDICIARY COMMITTEE.
