AN ACT
RELATING TO PUBLIC EDUCATION; LIMITING ASSESSMENTS TO THOSE REQUIRED PURSUANT TO FEDERAL ACCOUNTABILITY STANDARDS OR THOSE APPROVED BY LOCAL SCHOOL BOARDS OR CHARTER SCHOOL GOVERNING BODIES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
SECTION 1. A new section of the Public School Code is enacted to read:
"[NEW MATERIAL] LOCAL SCHOOL BOARD AND CHARTER SCHOOL GOVERNING BODY SELECTION OF ASSESSMENTS.--Notwithstanding any contrary provision of the Public School Code, an assessment that is not mandated pursuant to federal accountability standards or a waiver to federal accountability standards shall be administered in a public school only if the assessment is approved by a local school board or a governing body of a charter school."
