SENATE FLOOR AMENDMENT number ___1__ to SENATE BILL 56, as amended

Amendment sponsored by Senator Carroll H. Leavell

    1. On page 25, line 14, after "superintendent", insert "and are not subject to the Inspection of Public Records Act".

    2. On page 25, line 15, strike "This information shall not be made public." and insert in lieu thereof "Nothing in this section shall be construed as a grant of privilege or confidentiality or a bar to production of that information by an insurer in a civil suit, whether or not the office of superintendent of insurance is a party.".

    3. On page 67, line 12, strike "privileged, not" and insert in lieu thereof "are not".

    4. On page 67, line 13, strike ", not subject to subpoena and,", strike line 14 in its entirety and on line 15, strike "admissible in evidence; but" and insert in lieu thereof ". Nothing in this section shall be construed as a grant of privilege or confidentiality or a bar to production of that information by an insurer in a civil suit, whether or not the office of superintendent of insurance is a party; provided that".

    5. On page 107, line 18, strike "privileged," and insert in lieu thereof "is".

    6. On page 107, line 19, strike ", not subject to", strike line 20 in its entirety and on line 21, strike "discovery or admissible in evidence" and insert in lieu thereof ". Nothing in this section shall be construed as a grant of privilege or confidentiality or a bar to production of that information by an insurer in a civil suit, whether or not the office of superintendent of insurance is a party".

    7. On page 174, lines 17 and 18, strike "by law and privileged," and insert in lieu thereof "and".

    8. On page 174, line 19, strike ", shall not be subject to subpoena and are not", strike line 20 in its entirety and on line 21, strike "civil action. The" and insert in lieu thereof ". Nothing in this section shall be construed as a grant of privilege or confidentiality or a bar to production of that information by an insurer in a civil suit, whether or not the office of superintendent of insurance is a party; provided that the".

    9. On page 174, line 25, after "person", insert ", except to insurance departments of other states,".

    10. On page 178, lines 14 through 20, strike Subsection F in its entirety and insert in lieu thereof a quotation mark.
