A JOINT MEMORIAL

REQUESTING THE NEW MEXICO LEGISLATIVE COUNCIL TO DIRECT THE APPROPRIATE INTERIM LEGISLATIVE COMMITTEE TO ASSESS THE NEED TO REGULATE FINGERPRINTING.

     WHEREAS, many professional occupations require that entrants to the profession complete and pass a state and national criminal background check; and

     WHEREAS, a state and national criminal background check generally requires that a person submit fingerprints; and

     WHEREAS, several private corporations in New Mexico offer fingerprinting services; and

     WHEREAS, the private-industry provision of fingerprinting services is an unregulated field; and

     WHEREAS, those who offer fingerprinting services have access to sensitive personal information; and

     WHEREAS, there is a potential for a provider of fingerprinting services, in the course of providing those services, to commit fraud;

     NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO that the appropriate interim legislative committee be requested to explore issues related to fingerprinting services; and 

     BE IT FURTHER RESOLVED that the appropriate legislative committee make recommendations as to the need for regulation of private fingerprinting services or the restriction of such service provision to law enforcement agencies; and

     BE IT FURTHER RESOLVED that copies of this memorial be transmitted to the co-chairs of the New Mexico legislative council.
