    Your CONSUMER AND PUBLIC AFFAIRS COMMITTEE, to whom has been referred

HOUSE BILL 438

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

     1. On page 1, lines 13 and 14, strike "REMOVING THE REQUIREMENT OF SENTENCING DEFENDANTS CONVICTED OF MISDEMEANORS TO A COUNTY JAIL;".

     2. On page 6, lines 5 through 24, strike Section 2 in its entirety. 

     3. Renumber the succeeding sections accordingly.

     4. On page 8, lines 18 through 21, strike the underscored material. 

     5. On page 8, line 25, after "department", insert "that exceeds one year or has agreed and been ordered to serve a period of parole by the court".

     6. On page 9, lines 8 through 12, strike the underscored material.,

and thence referred to the JUDICIARY COMMITTEE.
