    Your PUBLIC AFFAIRS COMMITTEE, to whom has been referred


HOUSE BILL 260, as amended


has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:


    1. On page 1, line 15, after "REQUIREMENTS", insert "AND TO PROVIDE LIMITED AUTHORIZATION FOR REGISTERED NURSES AND CERTIFIED NURSE-MIDWIVES TO PERFORM CERTAIN ULTRASOUND PROCEDURES".


    2. On page 3, line 5, after "health", insert "bureau of the field operations and infrastructure".


    3. On page 3, line 6, strike "of environment".


    4. On page 4, line 24, strike "optical" and strike line 25 in its entirety.


    5. On page 5, line 1, strike "lasers,".


    6. On page 7, line 4, after "to", insert a colon, strike lines 5 through 9 in their entirety and insert in lieu thereof the following new paragraphs:


             "(1) a licensed practitioner;


             (2) a health care practitioner licensed or certified by an independent board operating pursuant to Chapter 61 NMSA 1978 or a state regulatory body; provided that any medical imaging certification and examination program for health care practitioners established by an independent board or state regulatory body shall be submitted to the advisory council and approved by the board; or


             (3) a registered nurse or certified nurse-midwife performing ultrasound procedures; provided that the registered nurse or certified nurse-midwife has documented demonstration of competency within the registered nurse's scope of practice in compliance with board of nursing rules or the certified nurse-midwife's scope of practice in compliance with department of health rules. A registered nurse or certified nurse-midwife may perform ultrasound procedures limited to a focused imaging target. A registered nurse or certified nurse-midwife shall not perform diagnostic ultrasound.".


    7. On page 7, line 10, before "The", insert the subsection designation "C.".


    8. Reletter the succeeding subsections accordingly.


    9. On page 8, line 12, strike the closing quotation mark.


    10. On page 8, between lines 12 and 13, insert the following new subsection:


         "H. A registered nurse or a certified nurse-midwife shall not perform ionizing procedures, including radiography, radiation therapy, nuclear medicine or a non-ionizing magnetic resonance procedure, unless licensed by the department as a medical imaging professional. Nothing in the Medical Imaging and Radiation Therapy Health and Safety Act shall affect the authority of a health care professional licensed pursuant to Chapter 24 or Chapter 61 NMSA 1978 to order or use images resulting from ionizing or non-ionizing procedures in accordance with the licensed health care professional's scope of practice."".,
