AN ACT

RELATING TO HIGHER EDUCATION; PROHIBITING LEGISLATIVE GENERAL FUND APPROPRIATION DISTRIBUTIONS TO PUBLIC POST-SECONDARY EDUCATIONAL INSTITUTIONS FOR COLLEGES OF EDUCATION OR TEACHER PREPARATION PROGRAMS THAT DO NOT PROVIDE INSTRUCTION WITH COURSES THAT ARE BASED ON SCIENTIFIC READING RESEARCH AND THE SCIENCE OF READING, THAT ARE ALIGNED WITH THE STATE READING STANDARDS AND THAT MEET OTHER REQUIREMENTS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. PUBLIC POST-SECONDARY EDUCATIONAL INSTITUTIONS--TEACHER PREPARATION--SCIENCE-BASED READING INSTRUCTION.--

          A. To qualify for legislative general fund instruction and general purposes funding, a college of education or teacher preparation program at a public post-secondary educational institution must instruct students in the teaching of reading courses that are based on current scientific reading research and the science of reading, that are aligned with public-education-department-adopted reading standards and that include strategies and assessment measures to ensure that beginning teachers are proficient in teaching reading.

          B. No legislative general fund appropriation to a public post-secondary educational institution for instructional and general purposes shall be distributed to a college of education or teacher preparation program if the college or program does not meet the requirements of Subsection A of this section during the fiscal year in which the legislative general fund appropriation is to be distributed. The higher education department shall certify that the college of education or teacher preparation program meets the requirements of Subsection A of the section.
