Your JUDICIARY COMMITTEE, to whom has been referred
SENATE BILL 96, as amended
has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:
1. Strike all senate education committee amendments.
2. Strike Senate Finance Committee Amendment 1.
3. On page 1, line 16, after "GRADE", insert "WITH CERTAIN EXCEPTIONS".
4. On page 2, between lines 6 and 7, insert the following new paragraph:
"(1) "academic proficiency" means a score on the statewide standards-based assessment that is higher than the lowest level established by the department;".
5. Renumber the succeeding paragraphs accordingly.
6. On page 2, between lines 21 and 22, insert the following paragraph to read:
"(5) "proficient in reading" means a score on the statewide standards-based assessment that is higher than the lowest level established by the department;".
7. Renumber the succeeding paragraphs accordingly.
8. On page 3, strike lines 5 through 7 and renumber the succeeding paragraphs accordingly.
9. On page 6, line 7, strike "At" and insert in lieu thereof "Beginning with the 2013-2014 school year, at".
10. On page 6, line 23, after the period strike the remainder of the line, strike lines 24 and 25, strike page 7, line 1 and insert in lieu thereof:
"F. If a student is not proficient in reading after completion of the prescribed intervention and remediation programs in kindergarten through grade three, the parent may petition the school principal to promote the student to the next grade if the student has attended school for at least ninety-five percent of the instructional time during the school year and has participated in all required levels of remediation prescribed by the school district in the reading improvement plan, and the parent signs a contract that outlines a reading intervention plan for the next grade. No student shall be retained for a total of more than one school year between kindergarten and grade three as a result of not having attained proficiency in reading.".
11. Reletter the succeeding subsections accordingly.
