AN ACT

RELATING TO STATE REGULATION; AMENDING THE REGULATION AND LICENSING DEPARTMENT ACT TO REQUIRE THE REGULATION AND LICENSING DEPARTMENT TO ESTIMATE THE COST OF REGULATORY COMPLIANCE BY TYPES OF BUSINESSES; REQUIRING THE REGULATION AND LICENSING DEPARTMENT TO PUBLISH THOSE ESTIMATES ON THE SUNSHINE PORTAL ANNUALLY AND TO PROVIDE A REPORT TO THE LEGISLATIVE INTERIM REVENUE STABILIZATION AND TAX POLICY COMMITTEE OF THE LEGISLATURE ANNUALLY.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. Section 9-16-1 NMSA 1978 (being Laws 1983, Chapter 297, Section 17) is amended to read:

     "9-16-1. SHORT TITLE.--[Sections 17 through 29 of this act] Chapter 9, Article 16 NMSA 1978 may be cited as the "Regulation and Licensing Department Act"."

     SECTION 2. A new section of the Regulation and Licensing Department Act is enacted to read:

     "[NEW MATERIAL] ADDITIONAL DUTIES--ESTIMATED COST OF COMPLIANCE.--

          A. The superintendent shall:

                (1) establish a program to estimate the cost to businesses of complying with state laws, and rules promulgated pursuant to law, that pertain to the businesses' ability to operate in the state. The estimates shall be classified by industry, including:

                     (a) agriculture;

(b) forestry, fishing and hunting;

(c) mining and oil and gas extraction;

(d) utilities;

(e) construction;

(f) manufacturing;

(g) wholesale trade;

(h) retail trade;

(i) transportation and warehousing;

(j) information and cultural industries;

(k) finance and insurance;

(l) real estate and rental and leasing;

(m) professional, scientific and

technical services; 

(n) management of companies and

enterprises;

(o) administration and support;

(p) waste management and remediation;

(q) educational services;

(r) health care and social assistance;

(s) arts, entertainment and recreation;

(t) accommodation and food services;

(u) public administration; and

(v) other services;

                (2) report annually to the legislative interim revenue stabilization and tax policy committee regarding its findings on the estimated cost of compliance for businesses, classified by industry; and

                (3) publish annually on the sunshine portal the estimated cost of compliance for businesses, classified by industry.

          B. The superintendent may coordinate with universities, other agencies, the legislative finance committee and businesses operating in the state to collect information to ensure more accurate estimates."

     SECTION 3. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2012.
