AN ACT
RELATING TO MEDICAL ASSISTANCE; ENACTING A SECTION OF THE PUBLIC ASSISTANCE ACT TO REQUIRE THE SECRETARY OF HUMAN SERVICES TO SUBMIT A FISCAL IMPACT ANALYSIS WHEN MAKING CERTAIN CHANGES TO THE STATE'S MEDICAID PROGRAM.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
SECTION 1. A new section of the Public Assistance Act is enacted to read:
"[NEW MATERIAL] MEDICAID PLAN AMENDMENTS--FISCAL ANALYSIS.--The secretary shall submit a written analysis to the legislative finance committee and the department of finance and administration regarding the expected fiscal impact at least sixty days prior to:
A. submitting amendments to the medicaid state plan for federal approval;
B. applying for federal approval of a waiver of state medicaid plan requirements; or
C. submitting for federal approval amendments to an existing waiver of state medicaid plan requirements."
