A JOINT RESOLUTION
GRANTING APPROVAL TO THE CULTURAL AFFAIRS DEPARTMENT TO LEASE LAND ADJACENT TO THE SPENCER THEATER IN ALTO, NEW MEXICO.
WHEREAS, Section 13-6-3 NMSA 1978 requires ratification and approval by the state legislature of any lease of state agency-owned property that is more than twenty-five years in duration and is for a consideration of one hundred thousand dollars ($100,000) or more; and
WHEREAS, the cultural affairs department shall hold title to the following described property, consisting of approximately one hundred thirty-nine acres in Alto, New Mexico:
A tract of land being a portion of the S ½ N ½ and a portion of the S ½ of Section 17, and being a portion of the SE ¼ SE ¼ of Section 18, T10S, R14E, N.M.P.M., as shown by the ALTA/ACSM Land Title Survey thereof filed in the office of the County Clerk and Ex-Officio Recorder of Lincoln County, New Mexico, on February 15, 1996, in Cabinet F, Slide No. 372; and
WHEREAS, the property described above is undeveloped and is situated across the road from the Spencer theater, which has been an important cultural resource in southeastern New Mexico, providing contemporary performing arts programs of national caliber to the Ruidoso community and the surrounding southeastern region of New Mexico and influencing tourism in the area by serving as a draw to out-of-state visitors, thereby impacting the economy locally and adding to the tax base of the entire state; and
WHEREAS, the board of regents of eastern New Mexico university desires to lease the described property so that it may be managed and developed into a branch community college campus at Ruidoso, including a performing arts academy that would develop students capable of working in national-caliber performing arts venues; and
WHEREAS, the cultural affairs department has determined that it is in the best interest of furthering these goals of the board of regents of eastern New Mexico university to lease the described property to eastern New Mexico university;
NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO that the cultural affairs department be authorized to lease the described property for a period exceeding twenty-five years to the board of regents of eastern New Mexico university for the university to develop and manage the described property as a campus at Ruidoso.
