AN ACT
RELATING TO THE LEGISLATURE; ALLOWING EMPLOYEES OF EDUCATIONAL INSTITUTIONS TO SERVE AS LEGISLATORS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
Section 1. Section 2-1-3 NMSA 1978 (being Laws 1943, Chapter 18, Section 1, as amended) is amended to read:
"2-1-3. COMPENSATION AS STATE OFFICER OR EMPLOYEE OTHER THAN THAT RECEIVED AS A LEGISLATOR PROHIBITED--EXCEPTION.--It is unlawful for any member of the legislature to receive any compensation for services performed as an officer or employee of the state except such compensation and expense money as [he] the member is entitled to receive as a member of the legislature. For the purposes of this section, an employee of the state does not include an employee of a state educational institution pursuant to Article 12, Section 11 of the constitution of New Mexico."
Section 2. Section 2-1-4 NMSA 1978 (being Laws 1943, Chapter 18, Section 2, as amended) is amended to read:
"2-1-4. PAYMENT OF OTHER COMPENSATION TO LEGISLATOR FOR ACTING AS OFFICER OR EMPLOYEE OF STATE PROHIBITED--EXCEPTION.--It is unlawful for any officer of the state [of New Mexico] to pay to any member of the legislature compensation for services rendered the state [of New Mexico] as an officer or employee thereof except such compensation and expense money [which such] that the member is entitled to receive as a member of the legislature. For the purposes of this section, an employee of the state does not include an employee of a state educational institution pursuant to Article 12, Section 11 of the constitution of New Mexico."
