FORTY-NINTH LEGISLATURE

    Your JUDICIARY COMMITTEE, to whom has been referred

SENATE BILL 463, as amended

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

     1. On page 45, strike line 21 through "parent" and insert in lieu thereof "Donors of eggs, sperm or embryos are not the parents".

     2. On page 45, line 23, strike "PATERNITY" and insert in lieu thereof "PARENTAGE".

     3. On page 45, line 24, strike "man" and insert in lieu thereof "person" and strike "sperm" and insert in lieu thereof "eggs, sperm or embryos".

     4. On page 45, line 25, strike "by a woman".

     5. On page 46, line 2, strike "her" and insert in lieu thereof "a".

     6. On page 46, strike lines 6 through 9 in their entirety and insert in lieu thereof the following new subsection:

          "A. The intended parent or parents shall consent to the assisted reproduction in a record signed by them before the placement of the eggs, sperm or embryos. Donors shall also consent to an assisted reproduction before retrieval of the donors' eggs or sperm.".

     7. On page 46, line 10, strike "man" and insert in lieu thereof "parent".

     8. On page 46, line 11, after "section" strike the remainder of the line.

     9. On page 46, line 12, strike "child,"; strike "paternity" and insert in lieu thereof "parentage"; and strike "woman" and insert in lieu thereof "parent".

     10. On page 46, line 13, strike "and the man".

     11. On page 46, line 14, strike "together".

     12. On page 46, line 15, strike "their" and insert in lieu thereof "the parent's".

     13. On page 46, line 19, strike "for good cause shown" and insert in lieu thereof:

"or with the consent, in a signed record, of:

                (1) the donor or donors; and

                (2) the parent or parents who consented to the assisted reproduction pursuant to Subsection A of this section or

a child who was born as a result of the assisted reproduction pursuant to Subsection A of this section if the child is eighteen years of age or older".

     14. On page 47, line 25, before "record" insert "signed".

     15. On page 48, line 2, strike "The" and insert in lieu thereof "Unless otherwise agreed in a signed record, the".

     16. On page 48, line 3, after "a" insert "signed" and after "record" insert "delivered to the other person".

     17. On page 48, line 4, after "embryos" insert "if the placement has not occurred within one year after the consent".

     18. On page 48, line 12, before "record" insert "signed".
