AN ACT

RELATING TO COUNTIES; SETTING HEALTH CARE PROVIDER REIMBURSEMENT RATES FOR HEALTH CARE DELIVERED TO PERSONS IN COUNTY JAIL CUSTODY.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. HEALTH CARE PROVIDER REIMBURSEMENT--COUNTY JAILS--EXCEPTION.--

          A. A county shall reimburse a licensed health care provider, including a licensed mental health care provider, that renders services to an individual in the custody of a county jail in accordance with rules promulgated pursuant to Section 52-4-5 NMSA 1978.

          B. Notwithstanding the provisions of Subsection A of this section, a county may enter into agreements with health care providers to set rates, charges or reimbursable amounts that differ from those established pursuant to the provisions of Subsection A of this section.
